This is a follow-up to comment # CA52866.
It is understandable when wrongdoers keep repeating their misdeeds, that's what they do, it’s what they live for, but it is mind-boggling when a judge who is sworn to uphold the Constitution adopts lawbreaking behavior, when she departs from her judicial and moral obligations to unjustly benefit one party over the other then scramble in attempt to cover such misconduct. The irony that in attempting to rectify a perceived injustice, judge Mandel made matters worse by creating breach of ethics.
As previously mentioned, the signed judgment was missing Exhibit "A" which consists of six pages and was therefore incomplete, and our request to include it, among other things, was ignored. But since some judges behave as if the court is their inheritance that has been left to them by their ancestors, six months later, the decision was made to make it appear as if the signed judgment dated September 7, 2023, indeed included the six pages (Exhibit "A"). To effectuate that scheme, it was apparently decided to stealthily enter it in the docket sheet, falsely pretending that it has been filed and served by the clerk on September 7, 2023 (which is absolutely untrue), then realized afterwards that the proof of service was not included, so a separate proof of service appeared suddenly in the court file on February 28, 2024 (nearly six months after the date of the fake filing). What judge Mandel and her assistants don’t know is that we have a definitive proof that they lied, that said missing pages were not filed, entered or docketed on Sept. 7, 2023. In other words, that judge and whoever was involved in our case simply cheated and deceived the entire courthouse.
Wasn’t it enough for Mandel to deprive the victims, who are the injured party, in the literal sense, of receiving the compensation they deserve for their medical care? Why does she value the criminals who committed theft and fraud over her judicial integrity? Our objection to proposed judgment with references to Exhibits dated 8/8/23 and our Exhibit list dated 7/3/23 with references to hundreds of pages of Exhibits (which were returned to us, as per court rules) expose judge Mandel’s flagrant bias and corrupt ruling.
We have been unfairly treated, twice, by judge Mandel, first when she fabricated claims and argument in order to justify her corrupt ruling, and now she deliberately cheated the entire system by falsely claiming that the signed judgment (with Exh. A) has already been filed and docketed in September 2023. This is called deceit and due process violation.
In three words we can sum up our experience with judge Mandel: prejudice, greed and nepotism. Case # SC121825.

A few weeks before trial, a court official unexpectedly decided to transfer our case from Santa Monica to Beverly Hills, but after our protest the case was retransferred back to Santa Monica. It was unfortunately transferred to judge Mandel, who knew nothing about the case, and not to the original trial judge. It is no secret that some judges will do their best to save the face of a defendant who happens to be an attorney, even if that attorney committed theft from his clients, worse yet, even if he/she was disbarred for misappropriating tens of thousands of dollars from former clients. That has proven true with judge Mandel, she went above and beyond to save the defendant, our former, a now disbarred attorney Gregory F Stannard, from imminent humiliation. Not only did that man steal our large file which contains confidential documents and expensive personal belongings, but he also did not submit one single document pertaining to our P.I. case to the jury in the underlying action including our past medical expenses even after he was asked by the jury, he failed to prepare the jury instr., the judgment (as ordered by the judge), and the Memorandum of Costs, then disappeared with our file. The disbarred attorney let the crooked Mercury Ins. defense counsel Douglas P Vining and the rest of his team prepare all of the above where they excelled in committing all sorts of fraud, to the extent that one of them (steven J Horn) changed our status from Plaintiffs to defendants in the underlying action in order to be able to commit even more fraudulent acts against us. They all owe us hundreds of thousands of dollars. During trial Judge Mandel carefully and meticulously examined all of our evidence including economic and noneconomic ones, she found herself caught between a rock and a hard place, either to base her decision on the evidence and the law or to turn a blind eye to whatever shred of ethical principle remained in her troubled conscience. She chose the latter.
The entire ruling is based upon non-existent fabricated facts and arguments as to all causes of action, nowhere in the entire record is there any allegations, arguments or evidence such as the ones invented by Mandel. She even lied regarding the fact that has been proven, by a preponderance of the evidence, that the party who submitted the proposed jury instr. and whose requested instructions was given was the defense attorneys, not the defendant simply because the defendant’s proposed jury instr. were refused/withdrawn by the judge in the underlying action. No honorable superior court judge would base his/her decision upon speculation as to what might have happened if something has or has not happened, but this is what Mandel did. This is actually more embarrassing for her than anyone else. As we said in our objection: “Speculation and conjecture cannot become guide for determining the truth.” We filed objections to the court’s decision; our objections were overruled. Even the signed judgment was missing six pages and was therefore incomplete, we filed a request for inclusion of the missing pages, but our request was ignored. None of this would have happened if our case was not transferred to that dishonorable judge.
If there is such a thing as a statute of limitations governing principle of human morality, then Judge Mandel’s statute of limitations on judicial integrity, honesty, and professional competence has long been expired. Case # SC121825

Judge Mandel is stuck on her tentative rulings. She will not consider oral argument points even if the law is supporting your cause. She seems angry, short in explanations, and having low patience. I have argued in front of her a couple times on different matters. I did not find her to have any fairness or compassion which is the basic requirements of a judicial officer.

Mandel is a hot temper, rude, loud & impatient judge. She is often very angry & takes sides while picking her favorite attorney! While a victim might be getting victimized second time by her, she refuses to be fair & provide relief! The biggest liar in her court room wins! She is pro-defendants specially those of her own kind! Her judicial assistant Priscilla is a nightmare who get all the minute orders wrong. Together Mandel & her judicial assistant are a disaster you want to avoid! 170.6 this inept judge immediately! Stay away from her court room!

The way We see her is that she thinks her court room is her private office that she can do her ruling based on her emotion! Like versus dislike . She does not follow law, statues and regulations . She also look at different races , different religious somehow differently and discriminate based on her feeling! She look as if she is bringing her biases into court room . They say justices is blind but she Can not separate between her feelings and her emotions, separate from her judgment when she does her ruling! Raciest and prejudice!

All the negative critiques of Judge Mandel's judicial temperment and lack of attention to the details of her docket are absolutely true. I would add that she does not understand the law in many critical instances, for example case-determinative law and motion, and seems to resent any endeavor to understand the law because it would impose more burdens on her. Also, as stated in many critical posts of her, she harbors grudging bias, not merely against the "flavor" of particular cases but against particular attorneys. She is a miserable wretch.

Judge Elaine W Mandel is the worse judge in Los Angeles county. She is a hot temper, impatient and the most unprofessional judge you will come across! She is constantly complaining that her case load is too much, she complains about her real estate & neighbor’s dispute cases as if you’re bothering her bringing in a motion which she always gets wrong anyways! She picks her favorite then act as if she is their lawyer, 170.6 this fool if you’re unfortunate enough to be assigned to her! The tax payers are paying her salary so she should stop complaining or go back to small claims court where she really belongs!

Does NOT read the motions filed, doesn’t even look at her own docket for filings, states the most ludicrous ideas that are so out there, that you are just waiting for her to order a unicorn to bring you into her next hearing. The biggest liar (opposing council) in the room can easily fool her. Shocking that she has held on to her job this long! As a former small claims judge, she should seriously reconsider going back there where she can rule from her gut feelings which are 90% wrong!

Judge Mandell won't let anyone file a discovery motion unless they have held hands in her courtroom and sung kumbaya with the other side. If her caseload is clogged she has only herself to blame. She really belongs in small claims court where she can rule from her gut and doesn't have to follow the pesky law.

The good: generally pragmatic; cuts to the chase; good courtroom management; does not seem biased; seemingly smart.
The bad: does not follow the law and rules by her own "gut;" no logical consistency in her rulings (essentially, "splits the baby" even when doing so is contradictory to her rationale for each side of the ruling).
If you're looking for a judge just to get your case over with, regardless of the outcome, then Judge Mandel will be OK for that. (She'd probably be a better settlement judge, than trial judge.)
