Judge Burrell is thoughtful, intelligent, and thorough. Most importantly, he is willing to reconsider his initial opinions of an issue and he will go deeper than the briefing to ensure all potential issues are addressed. My impression is he does not want to be wrong, but he is willing to admit when he is, and these qualities in a judge are key to a fair judicial system.

I was convicted of a federal felony because, after my house burned down and my wife and I lost all of our possessions, I told a grand jury that my house burned down and I lost all of my possessions! At trial I had two prosecutors, Judge Burrell and AUSA Daniel S Linhardt. I was ridiculed at every turn by Judge Burrell while he showed great deference to lying AUSA Linhardt, who prosecuted me because I wouldn't lie to help him prosecute my brother for white-collar crime. In a pre-trial hearing Judge Burrell intimidated my paid attorney to the point that I was denied effective representation - he told my attorney that he *will* sanction him after the trial!

Judge Burrell is often criticized for being gruff to litigants. My experince is that his gruffness is directly related to the amount of preparation the attorney does to advance the case along. Judge Burrell and all of the other jduges on the Eastern District bench are very busy and want attorneys to be prepared to help move cases along. if you are not prpared, Judge burrell will make his displeasure known to you. WOuld take Judge Burrell over most of the newest appointments (except for Muller) for any case.

All that is wrong with lifetime appointments. Thinks he knows everything. Hates all criminal defendants and their lawyers. Takes it personal if a criminal defense attorney advocates on behalf of their client. Mean spirited and willing to sentence 70 year old, wheelchair handicapped, moderately retarded, illiterate, minority women (prior victim of horrendous assault) to lengthy prison for low level fraud, over request of probation and prosecution. Her bad luck was to be african american, which Judge Burrell is. he takes it out on her. Amazingly unconcerned with the law or applying it in criminal cases and appears unable to read and apply a criminal precedent.

Judge Burrell is not the brightest bulb on the court although he's taken over as Chief Judge for the man who was the brightest bulb and who will be sorely missed but is at greener pastures, following his father's footsteps (as a dean, not the same school) as Dean of Duke Law School although his buddy Erwin has now gone to Riverside!! My goodness, what will become of the court with the highest caseload in the country?
