Civil Litigation - Private

Comment #: 23472
Rating:1.0
Comments:
Judge Mosman is biased against pro se litigants and has a decided bias towards corporate litigants. He ignores evidence, especially when provided by a pro se litigant and he makes arbitrary summary rulings that violate the United States Constitution and other civil rights laws. He discriminates against protected classes and creates a hostile court environment when it comes to ADA disability accommodation. He retaliates against litigants who pursue civil rights claims and defenses.

Comments:
When he was appointed, I was nervous, given his political predisposition. I was wrong. He's a great judge. Comes phenomenally prepared. Even tempered. Sharp as a whip. I love that he says at the start "here are the questions I'd like addressed," and we can trim our arguments and get right to what the decision-maker expects. Haven't always won in front of him, but respect him at all times.

He is a Judge with an anti Plaintiff agenda. Clearly pro corporate bias.If you represent a corporation or insurance company being sued by an injured Plaintiff it is your lucky day. If you have an injured Plaintiff, you have no real chance

He comes in with just the right mix of formality and humor. He is always stunningly prepared. He tells you what issues he needs to hear discussed. He does listen to and is affected by good oral argument. I was concerned with his appointment, but he's made me a fan. And contrary to comment #4818, he ruled for the gay community in Lemmons v. Bradbury, so it may just be that lawyer.

Comments:
Wow - Judge Mosman is about as critical of lawyers as a judge is willing to admit. When asked to pick a luncheon topic, he chose to give a lecture to the bar on everything lawyers are doing wrong. He is generally defense-oriented and is a strict constructionist with regard to the rules. He is otherwise smart and decisive and fair with regard to timing and prejudice issues.

He is prejudiced against gays. A gay litigant or lawyer has a difficult time in his courtroom.
