Subject: Request for Review of Judicial Decisions - Judge Daniel Martin

Dear

I am writing to express my deep concerns regarding the handling of my divorce case by Judge Daniel Martin. I believe his decisions have had severe repercussions on my life and well-being.

As a stay-at-home mother for 25 years, I found myself in an extremely abusive situation during the divorce proceedings. My ex-husband coerced me into signing the divorce paperwork under threat, leaving me in a vulnerable position. Despite multiple letters from family and friends detailing the extent of the abuse and urging the reopening of the case, Judge Martin has not reviewed the evidence thoroughly.

Moreover, my ex-husband's involvement with criminal activities and my personal safety concerns have been disregarded. I have endured years of emotional and physical abuse, supported by testimonies from our children who share the same sentiments towards their father. The failure to consider these crucial factors has resulted in my current homeless state.

I firmly believe that Judge Martin has not adequately reviewed the documentation submitted, including an order of protection against my ex-husband that has been successfully upheld in court. This oversight highlights a disregard for the well-being of individuals facing dire circumstances.

Given the special circumstances surrounding my case, such as being financially dependent on my ex-husband and the threat to my personal safety, I kindly request a review of Judge Martin's decisions and an opportunity to present all the evidence I have gathered. As I am unable to afford legal representation, I seek guidance on filing a formal complaint against Judge Daniel Martin.

I sincerely hope that my concerns are taken seriously and that appropriate action is taken to address the issues at hand. It is essential that judges fulfill their duty to protect and serve those who are unable to protect themselves.

[Redacted by Ed.] DCS determined my children were abused. A medical professional determined my children were abused. My children were diagnosed with PTSD due to abuse. Previously, I had an upheld order of protection due to “this man being a viable threat”. Even so, Judge Martin determined that not only should the recommendations of the BIA not occur, the abuser should have final decision making, the children should not receive counseling or any treatment for their PTSD, child support should not be ordered (4 yrs of no support) and corporal punishment should not stop. He also decided that I should pay the legal and supervised visitation fees of the man who abused my children. A man who makes $1500 a month more then I do.

I have never witnessed a judge that pays so little attention to not only the evidence in a case but also to the wishes of a child. Judge Martin told my son that it is okay for his father to abuse him and that his voice means nothing to the court. Absolutely appalling.

His experience proves him to be incapable of discernment as he apparently sees litigation as nothing more than relativistic activity that he generally just prefers to just maintain status quo under any circumstances. He’s a good judge to those already having status, money, and many attorneys. Can’t see an apple for just being an apple because there’s so many qualities to an apple that he’d rather defer to in order to avoid declaring it so. No discernment.

He has a great staff who are an asset to his job performance on the bench. His rulings are well thought out and he's doing a great job on the family law bench. Considering how new the assignment is for him, his staff has been a tremendous asset in helping him make a smooth transition.
