This judge will ignore facts and law. He doesn't rule properly based on case laws. A word of caution, if you get stuck with him somehow, one way to get rid of them is file a writ to reverse his ruling and get a new preemptive recusal! Trust me, this will save some many headaches. He is a shame for our legal system.

run from this judge. Look him up on google and find all the mistrials he had and public admonishment in 2020 and prior private admonishment in 2011. He is behaving the same way today. Run from his cases if you can.

In 35 years of practicing exclusively civil litigation this is the worst piece of cr@p judge I have ever seen. When asked why he doesn’t follow the local rule on pre-motion discovery conferences he said “it’s too much bother.” This is a tired old man who goes with whoever shouts him down. Drink some coffee and get ready to start yelling!! This is no place for evenhanded intellects.

This judge is the most unfair judge I've appeared in front of in 25 years of practice. It seems that if he decides he does not like a party, he will rule against it and will disregard both the facts and the law with no shame at all in doing so, but he will cut you off if you try to make your record. He is rude to both counsel and to parties. In my opinion, he will prejudge your case and will try to strong arm your client into settling. He is often unfamiliar with the papers and often claims not to have received them even though they were hand delivered to his chambers. His unfamiliarity with the issues will not stop him from taking entrenched positions based on his misapprehension of the facts and law. Judges with this sort of temperament give our legal system a bad reputation. They have no business being anywhere near a courtroom.

The judge did not show good character in dealing with counsel or the parties. Exercise your CCP Section 170.6 rights. The judge gets angry for no good reason, and he is often petty. The court ruled without carefully evaluating the law. There are better judges in Alameda County.

The worst of the worst. I am a retired CPA and have testified in court as an expert witness on many civil and family law case. The Dishonorable Frank Roesch is the worst judge I have ever had the displeasure of testifying before; a real joke of a man.

His temperament is utterly unsuitable for a judge, commissioner or otherwise. Perennially angry, to the point where observers feel concerned for his general well-being.

A petty tyrant who will rule absolutely and at his personal whim. He searches the case desperately for something to be angry about and then proceeds to beat on all sides for causing him such great inconvenience.

Seems to hate attorneys. Although he appeared more well disposed to pro se litigants, the man has so much anger that he cannot be counted on to follow the law.

Avoid this judge at all costs. Since he's a commissioner, he's easy enough to avoid by merely not stipulating to his court.

Roesch (not "Honorable") ruled that a piece of personal property, given by the plaintiff to the defendant to sell to satisfy a loan the plaintiff owed to a third party (all signed and properly executed docs were presented) was stolen. The Fremont Police were involved and agreed that this was a civil matter...not criminal. Frank, take your head out of your tail end and take time understand the transaction and issues. This matter is now being adjudicated in another civil matter; not before Roesch.

Competent. Can be caustic from the bench. It is perceived this court is over-worked and that is reflected in the time this Judge has to become familiar with issues. There seemed to be little absorption of the law / codes cited in briefs. He seemed non-biased.

I have to agree with the "petty dictator" comment. I worked with him when he was a probate referee, but two months on the bench and all of a sudden he is God and attorneys are mere worms. Eventually, he's going to mouth off once too often and somebody is going to bitch slap him.

Even though with my case, the judgement didn't go in my favor and he didn't take what I had put as an estimate as the specified sum certain (specific dollar amount) as he had the discretion to liberally construe the pleading (as I represented myself and that I am not an attorney), I still believe and feel that he was fair and could smell deceit and when a person displays a more Machiavellian style. That means he is a very good judge since he can read people and can tell when they're being honest or not

I had to file suit against my ex, who I put through law school. Judge Roesch was professional and fair. I think that of all the judges I have had the displeasure of meeting (total of 5), Judge Roesch is one of the good ones and shouldn't be at such a low rating . If the judgement didn't go the way you had hoped, maybe it isn't the judges fault

I had to give this Judge a "10" on involvement in settlement discussions, because he actually advised the defendant to reject the settlement worked out with the Plaintiff, and ordered a settlement under much worse terms. Of course, when the defendant breached the settlement, he refused to enforce the settlement. So completely pro-defendant, its a wonder anyone ever pays their bills in Alameda County.
