I had one experience with this judge and it was not a good one.

Shortly before the hearing, the opposing attorney dropped a hint that he knew Judge Dau on a personal level. At the hearing, the opposing attorney did not even bother to show up. However, Judge Dau ruled in favor of the opposing attorney and in doing so, violated well established case law. Based on my experience, this judge is either shady, incompetent, or both. I will definitely 170.6 him if I draw him again.

Judge Dau is ill-prepared. He never rules on motions right away. He may know the law, but often will ignore it. When you remind him of it, he gets mad. He does not put any efforts at settling a cases and often will deny pertinent evidence that will bring your case to its knees.

As to the comment "if you are slack you will not like him" -- that's a pretty arrogant conclusion. Apparently, anybody who doesn't like him is a slob? I asked a group of attorneys who actually try cases, and they all said that he was a horror.

He is sneaky, and will come up with ways to submarine the side that he doesn't like. He makes no effort to settle. He makes a mess of a good case. I was informed by a past clerk that he selects a side to pick on, then destroys them. You are trying a case against him. He is a former Gibson Dunn guy. Get him off the bench.

Judge Dau is the kind of judge that you will either love or hate. If you're well-prepared, know the law, and put some effort into your work, you'll find him to be a good judge who will give you deference. On the other hand, he doesn't suffer fools gladly, so if you slack off, turn in poor work, and basically phone it in, you'll find him to be horrible.

Reads the stuff; willing to be corrected; wants to be fair. A quick mind. An old style judge willing to check his own laptop on a case if need be.
