Civil Litigation - Private

Comment #: CA1866
Rating:3.5
Comments:
This judge should not be on the bench. Doesn't like to make dispositive decisions; doesn't like to work up motions to make the legally correct decision. When she does make a ruling, she fails to make required "findings" (e.g., identifying a specific "question of fact" when denying MSJ). She makes her mind up early on in the case; and is easily swayed by plaintiff's lawyers to give them a "second chance", then a third, then a fourth. This ongoing process makes the litigation so lengthy, and costly, defendants will have to pay something to settle the case. (One class action case should have been dismissed on MSJ, but was allowed to pend in her court for 4 years). Also, weak on legal research, and analytilital skills. Often makes quick analogies to totally unrelated legal principles ("apples to oranges").
