The one and two star comments below accurately reflect my observations as a defendant in a case where Rita Miller presided as a judge. Court transcripts of hearings and my own observations of her performance on the bench, in real time were quite alarming. One would always assume and expect that a judge would read materials and invite explanations and arguments from both sides prior to issuing a ruling. This was not our experience. Thankfully she is retiring. Her personal biases and inability to read materials prior to hearings has resulted in prolongation and unnecessary expense in a straightforward case. Best wishes to her in her retirement or alternate career.

This is one of the worst judges I have ever appeared before. She ignores the law. She makes a conclusion in her mind and is not open-minded thereafter. She shows no respect for attorneys and treats them like garbage. Every court appearance requires one day of counseling with a therapist thereafter to recover. Stay away from this judge. She is not persnickety. Just bad! Plus, she'll take out her anger against an attorney on the client. Shame on you if you do a judge trial before her.

There are two kinds of judges. Those who look upn lawyers and their lawsuits aas an imposition ("What are you doing in my courtroom?") and those whose attitude is completely different ("How can I help the parties resolve this lawsuit>") Judge Miller falls into the latter category. She is studious, polite, evenhanded and helpful, the latter almost to a fault. An excellent judge.

Very good judge. Allows attorneys to try their cases, will work with lawyers to set a trial as early as possible, very fair to FEHA plaintiffs. Definite keeper.

Judge Miller is of apparently of the belief that demurrers and MSJs are a "waste of time." She rules that everything is a "jury question" even without evidence and in contradiction to the law. She doesn't rule on evidentiary objections, she allows (in pre-trial motions) incompetent evidence by the Plaintiff if it allows her to rule that something is a "jury question."

Hope things have gotten better in calendaring, motions were heard 6 months out when I had my case in front of her. Reads what you give her and makes informed decisions.

This woman is not even worthy of being called a judge. She is lazy and fails to do her homework or read the briefs completely. She comes to court unprepared and rarely issues tentatives. She certainly doesn't do all online so you can see them before court.

She clearly has biases and rule in favor of the party who she personally likes. She doesn't know the law well and it is basically Rita or Sonny's law that she follows.

She has poor judgment and is not a strategic thinking individual. Her mind is incredibly bottom-up an abstract a complete inability to see a concept.

She is rude and arrogant and loses her temper on the bench regularly.

She's clearly a Democrat so if you're representing a businessman look out.

170.6 must be exercised.

I think Judge Miller has biases and rules based upon them. She threatens to rule against parties that are not in awe of her. She is arrogant and irrational.

I think Judge Miller is intelligent and fair. I would not be afraid to try any case in front of her. She listens, she understands the law and she cuts through the bs. I don't agree with the other criticisms here, which sound like sour grapes. In particular, I do not think she is racist at all. I think that's spiteful nonsense. She seems like a decent person and I have had several cases in front of her.

The following story should tell you all you need to know about Rita Miller: During an informal settlement conference (over which she presided as well as subsequently acting as trial judge) Miller called opposing counsel and myself into her chambers and stated, "I have known Mr. Lachs for thirty years and one of you (meaning me) had better settle this case." It was a naked threat to undermine during trial proceedings if I didn't settle in the amount requested by defense counsel. During the trial she tolerated multiple deliberate misstatements of my name by the opposing counsel who remarked to me "Do all of you Goyim have two first names?" One could imagine this racist judge presiding over a trial against a person of Palestinian, Arabic or generally, non-Jewish origin. She is demonstrably biased against and contemptuous of non-Jews and has no genuine basis for remaining on the bench.

Judge Miller has ruled on a Demurrer to sustain that demurrer without leave to amend as well, without citing legal statues that she based her findings on. Cited cases were presented in court by the lawyer, and Judge Miller ignored the law, and ruled against the plaintiff. Judge Miller was arrorgant, and it was clear that she was prejudice in her findings.

Judge Miller is one of those judges who thinks she's a legal scholar, but really isn't. She is pompous, arrogant,lacks judicial temperament and refuses to let attorneys argue their cases, once she has made up her mind.

A great judge. She reads everything submitted and is always prepared. Gives everyone a chance to fully argue their positions and still manages to move her calendar without any unnecessary delay.
