Civil Litigation - Private

Comments:
We tried a case before him (plaintiff), and every single ruling he made came down against us. I could see that happening if they were all close calls, but the legal precedent on a couple of them was so strong that there's no way he should have ruled for the defense. In the end, we had inconsistent jury verdicts, and he didn't ask the jury to go back and clarify them. After questioning the jury about it, he just slapped together his own idea of what they meant to award and made that the judgment. Not financially feasible to appeal. Horrible. Would definitely bounce this judge if he came up again.

Judge Minning seems to be getting senile. He gives rulings that make sense to him, but are contrary to the law. His temperament is erratic. He will be pleasant to one attorney and, when given the slightest disagreement, he becomes volatile and abusive. I have had two cases before him. No more.

In the last year his work has suffered. Some say he wants to retire but can't because of "points"; others say since death of his adult son, he just doesn't really care anymore. He's a nice guy, but lazy.

He's crusty. I've had mixed results with him in terms of whether he understood the law and correctly applied the facts to the law. Middle of the road jurist at Stanley Mosk courthouse. You could do worse, so I would probably be hesitant to challenge him.

I have had the pleasure of handling cases in Judge Minning's court. He is slightly defense oriented, but works very hard. He once had opposing counsel and I deliver supplemental briefing to his home when he was going to be on vacation. He does not seem to have an ego at all. I have heard him say, things to the effect of, "Counsel, you and I disagree, perhaps you should let the Court of Appeals handle this." I have handled complex motions in his court where he has really delved into the issues and thinks hard about them. He has a sense of humor and handles most things in his chambers. There are very few other judges downtown that I would prefer to litigate a case in front of.
