Terrible Judge. He gets a lot of 170.6 because he just wants to clear the calendar. Bauer will issue whatever he needs to in motions for pretrial just to clear your case out. Seems gentle mannered but is very pro defendant and big law firm. He'll take a side and go with it. Ultimately, he wants your case gone and rather not do work. So off your case will go into oblivion with this judge.

He is quite pompous. I still remember when he refused to look in the code book on his bench to confirm what I told him, and he went with the gross misrepresentation of opposing counsel who was with a big name but crooked law firm. Up to that point I had thought he was a very good judge.

Appeared before him for numerous hearings. He's ruled on motions without even having read the moving or opposition papers!

What kind of judge self admits that he hasn't read the moving papers before ruling on critical issues?

incompetent, bias, lazy, and holds grudges.

Fair; Impartial; Prepared; It is obvious he has fully read the papers; He has a command of the law; Does his own research; He is a stickler for following proper procedure. If you don't follow the rules, he will rule against you or make you start over. You can't BS him. More judges should have his temperament and abilities and we'd have a fairer, more consistent, and impartial civil practice in OC.

Judge Bauer was very uneven in my case. He made some strong decisions early, but punted on decisions later on. He clearly favors members of the bar who are active in bar politics.

He had absolutely no deep understanding
and any knowledge about my case.
He never read my report ( the facts) and made a major ruling without allowing a discussion
I was the plaintiff. Even the defendant was surprisingly shocked

I wish that I had read the comments posted here as soon as this judge was assigned to my case, so I could have made a 170.6 request. I was clearly the "hated" attorney in the matter that I had before him. He definitely had his mind made up about the case, and me, and made no effort to hide it and the bias showed.

Judge Bauer did everything he could to assist the defense and minimize the damages in my plaintiff breach of contract and related tort case. Extremely impartial. The jury's verdict was for plaintiff, but again, the damages were low. The verdict was unclear in at least one respect and at plaintiffs' request he held a conference in chambers but he refused to put it on the record, ruled against plaintiffs on the issue, and let the jury go. He fancies himself a legal scholar; however, my experience is that he is intellectually dishonest as he pursues his desired result.

I have appeared before Judge Bauer a couple of times on a small civil matter. I cannot say enough good things about Judge Bauer. He is fair and provides attorneys plenty of opportunity to argue their positions, but doesn't listen long when the position is bullshit.

I think he treats lawyers very well. For example, once I stayed to watch law and motion once after my motion. There were two different lawyers tyring to withdraw from cases. Both lawyers were really having a hard time and he took the time to tell them exactly the steps each needed to take to get out of their respective cases.

On the substance of his judging, Bauer knows his shit. So, if you are going in to argue something stupid, you aren't going to put something over on him. As the other comments have noted, he does "pre-judge," but all that really means is that he has read and considered the papers thouroughly.

My experience with this Judge is negative. He rarely seems impartial and is very punitive with lawyers. My firm always 170.6's him for that reason. You never know if you're going to be the one he hates in the case.
