Civil Litigation - Private

Comments:
I appeared before Judge Bermudez about a dozen times. He is a no nonsense guy and has a bit of an ego. You better come to court fully prepared because he will be versed in your case, having read all papers filed. I found him slightly biased for defense, and he rarely deviates from his tentative rulings, despite oral arguments by counsel. Overall, I have found him fair to both sides, though.

Comments:
Terrible. Judge relies on unpublished opinions even after its pointed out, he declines to consider arguments except with nods, but never acknowledges them while sticking with tentative, even when he is shown his ruling is objectively wrong, legally wrong, factually wrong, and logically wrong. Judge does not control courtroom and permits personal malicious attacks without foundation. Judge is very pro plaintiff, very pro employee in employment disputes.

Comments:
J. Bermudez is pro-plaintiff / pro-employee in employment law claims. He misunderstands respective burdens and presumptions. For example, on one issue a bright-line "may recover fees" (yes or no) was analyzed under the probability of recovering fees and an employer's heightened burden to show bad faith. So, although attorney fees "may" be recovered under the motion (ccp 1030), because it required bad faith he ruled erroneously by analyzing the probability of meeting the bad faith standard. Employers should avoid him.

Rating:9.1
Comments:
Generally, a overall good and fair judge, with very slight pro-plaintiff lean. Calm cool and collected. He allows good opportunity for counsel to argue, and he is ready for hearings. Expect surprise questions, like "What about economic damages?" Thankfully, cases before him resolved before trial. He appears less flexible in scheduling or delayed matters, so bring amendments early and timely reserve jury, and continued trials are frowned upon.

Awful judge. Doesn’t know the law to the extent the judge should.

I am an out of county attorney.... only have one case in Riverside County...I am very impressed by Judge Bermudez. He cuts to the chase while still giving everyone an opportunity to be heard. I love that.

Comments:
This judge is very impressed with himself. I however, was far from impressed. He did not read the pleadings, nor understand the case. He prepared a script that he clearly does not evade from, despite compelling arguments during the hearing. I watched him do this to several attorneys, not just myself. I would avoid him like the plague, especially if you are counsel for the Plaintiff against a public agency or large corporation.

All EGO, no substance. Neither side is happy to be assigned to this constipated self-aggrandized man.
