A judge is to exercise the power of appointment impartially, on the basis of merit, without bias or prejudice, free of conflict of interest, and in a manner that promotes public confidence in the integrity of the judiciary.

This was not my experience after an assignment for a Mandatory Settlement Conference. Judge Foiles came in aggressively, refused to listen, interrupted frequently and clearly had his own agenda. He did not accurately communicate the parties settlement positions in, what appeared to be, an effort to sabotage any settlement efforts and force the case to trial. His comment was that San Mateo County needs more big plaintiff’s verdicts. He refused to obtain any demands or communicate any questions on parameters for the MSC to other parties.

His comment that “our” county needs significant plaintiff’s verdicts and efforts to sabotage settlement were clear showing of his bias and conflict of interest.

During my opening remarks he solicited the representative for the government for drinks then declared my remarks nonsense and ruled in favor of the government attorney without them issuing any remarks.
This is a man who should not be a judge.

This judge represents the worst of the San Mateo County small county small -minded judges. He is the paradigm for why the "old guard" of former prosecutors must go to have balance in that County. He should not be handling civil cases because he is ill-equipped and forces his prosecutor mentality on plaintiff's and their attorneys.

Judge Foiles is a horrible Judge. He is self centered, no integrity. He is not familiar with many civil codes. He is emotional and impatient in the court room. misinterpretation of law and ruling base on personal feeling. This Judge should not be dismissed from court room.

Judge Foiles is just not fair to out-of-county counsel. I have appeared before him many times practicing in San Mateo County, and he is consistently biased against out-of-county counsel.

Judge Foiles is an excellent settlement conference judge. He provides a fair analysis of the case and of the risks of trial and does a good job of communicating both with attorneys and the parties to settle the case when settlement is possible.

He is the worst of all judges. I hope the individual who was harassed by Judge Foiles in trying to obtain a restraining order and who wrote a comment about him will contact me. Judge Foiles refuses to even let my client try to obtain a restraining order knowing that he has purposely placed my client in danger. the ex husband was picked up with 12 guns, 2 assault rifles, 20 high capacity magazines, and 10,000 rounds of live ammo thanks to my client and me picketing. The guy walks free and the D.A. never recovered 3 guns registered to this violent felon. I fear for the safety of the residents of the Bay Area. He is a loose cannon, told his probation officer he has ten concussions, meaning that his temper is probably even more hair-trigger (literally), and continues to threaten my client and her daughter. If he decides to use a gun, it will be a massacre.

This morning, I had Judge Foiles, to determine whether a temporary restraining order that he signed into effect on 10/25/13 against an individual harassing me and my family would become permanent. The order was officially and directly served to the person to be restrained, that same day. The same party then violated said restraining order on three separate occasions afterwards, and local police officers investigated each time, obtaining documented evidence to warrant immediate arrest, which apparently never occurred. The restrained party did not even appear in court this morning, but this judge was so unreasonable to me -- he did not allow me to answer anything at length, while, nitpicking at me on superfluous matters, and I never even got to mention that the restrained person was a sexual pervert with an apparent interest in my six-year old daughter, as left on a recorded message on our home phone and re-recorded by the police officers. Unable to afford an attorney, I could not seem to answer the nitpicking questions fast or properly enough for this judge, and he suddenly ended up dismissing the case, without even hearing about the pedophile aspects of the subject of the restraining order. If this is how our courts and judges operate nowadays, we no longer have any hope for any fair and equitable justice to be dispensed by such so-called "judges" of the law. My appearance today was not about me and my problem, it was all about Judge Foiles. May God have mercy on us, because this self-absorbed twit certainly will not. What outraged me the most was that Judge Foiles's original signed temporary restraining order was not worth the paper that it was written on. It only took me five hours of my time initially to obtain, and its stipulations and requirements were violated with impunity. Why even bother to get such an order, when our courts are run by judges like this?
