He makes an attempt to have families consider resolving differences - but he makes decisions that seem to prolong litigation. Lawyers make arguments that ought to have some consideration but he mostly listens to ill-prepared parents emotionally struggle over zoom. But while he doesn't seem engaged with legal arguments from lawyers - he will let them testify as to facts they have not documented and are but second-hand recollections. He seemingly accepts this hearsay as evidence.

Where is the Honor of somneone who makes profit off of undocumented workers and false immigration claim support and deportation.
Judge Talamentes deliberately lied to protect wrongdoers, bigamy and improper governmental and public funds. I was forced by Judge Talamentes to consent dismissal of the entire case otherwise he was going to fraudulently sanctioned me. Recently all over the news he posted hate, discrimination and racist against our peace officers to make himself and wife to look as nice and protector or illegal immigrants for profit as secondary gain. He used the words "KKK" having officers using abusive uniforms. And, he walks away with impunity.
To my point of view and believe: Judge Talamantes is a US TRAITOR, Opportunist who act as terrorist imposing fear on people for his and his family financial gain. He needs to be removed from court

Hi all,

Thank you to whomever set up this site! It feels like a support group for victims of this "judge", makes me feel better that there are others out there who have gone through what I have.

My case was a small claims case to get my neighbor to pay the $2000 that it cost to repair her sewer line that runs across my backyard (there is no sewer easement for her across my property, so technically it shouldn't be there anyway). Per written order of the city's sewer coordinator, this neighbor was told that she was responsible for the repairs. After she ignored multiple requests to fix it, I hired a contractor to do the work, provided her the bill, which she didn't pay, and that is how I ended up in small claims. I provided all of this documentation to him in writing.

On the day of the hearing, he asked me to explain my side of the story. I asked him "did you read the documents?" to which he replied, "I have them printed here in front of me," which is an interesting way to answer that question. So, I started to read my summary points that I had provided him, and then he interrupted me with questions about a completely different topic - our neighbor's use of our stairs to access a street. My neighbor also provided some anectodes about her being a victim, a woman with health issues that was being harrassed (by me). Her "story" found sympathetic ears with Mark T., who then proceeded to needle me with questions for an hour about this walkway.

He didn't want to hear my side of the story. That this neighbor tresspasses on our property, harasses us, our workers, films our children, and is stalking my little sister. I think he thought he was fighting injustice--he was very emotional.

So, this walkway is the subject of another case, which will go in front of a real Land Use attorney (not a family law guy). But Mark really thought I was a jerk, and towards the end Mark told me with a sneer, "I hope you lose that other case."

In the end, he ruled against me and ordered me to pay this neighbor $75. And the horrible adjectives used in the written judgement, the character assassination...I still can't believe it.

My experience was pure theater - he didn't look at the evidence I had provided at all, he just sort of shot-from-the-hip.

But now I'm worried that - because he thinks I'm the bad guy here - that he might influence that other, much more important case. Is Mark close to the other judges - do they take lunch together, golf together? I could see "judge" T smearing me in front of this other judge, and potentially influencing that judge's opinion against me.

So, not only am I out $2,000, now I have a judge who might be working behind the scenes to damage my land use case.

I should have never tried to seek a remedy in court, this has been a complete nightmare with this judge. What an abusive bully.

As an attorney, it is difficult to sit in his court room and listen to the gross miscarriage of justice. It's like the protections of the law and Constitution have gone completely out the window, and he just makes up his own rules. I have heard him say things like: "ma'am, are you sure you want a domestic violence restraining order? After all, this guy is the father of your child." If anyone asks for a trial, his immediate response is: "trials don't happen in family law. no one gets what they want." Lord help you if you are a pro per because there is absolutely no mercy. If there is an edgy pro per, as there often is, he will engage with them instead of trying to diffuse the situation. Pretty much every attorney in this jurisdiction will 170.6 him - but be sure to be ready to file an appeal if you do. Unbelievably, he has routinely wrongfully denied 170.6s. His court room is filled with biased and ignorance of the law. Bring your vomit bag.

This judge is lazy, rude, and incompetent. He doesn’t follow the law and does not even bother to read submissions. He is bias and lacks knowledge of basic facts in a case which he is hearing. Or really not hearing since again he doesn’t read anything and doesn’t let you talk unless he’s grilling you telling you he doesn’t believe you. I don’t believe him. When I was able to bring up basic facts of the matter which were in my submission numerous times, he had no knowledge of them. The entire case was about those so how can he not be aware of the case he is ruling on?!! This guy is the worst judge I’ve ever come across.

He hates and is paranoid of any type of firearm or BB Gun, and like all California judges in California, violates their "Oath of Office" to the US Constitution and Cal State Constitution.

The following are Talamontes words; a Copy & Paste from a very recent transcript:

Hon. M.A. Talamantes absolutely skewered a woman in court today who was seeking increased visitation with her daughter. He stated that if the daughter were to commit suicide it would be solely the fault of the woman/mother. He nonchalantly addressed the man/father's pending CPS case of using a belt on the daughter and believed at face value that that same man was a reliable witness in reporting his daughter's behavior after visits with the woman/mother. Some of the allegations from the father sounded almost absurd (i.e., that mom is coaching the daughter to abuse her stepmother so that they can be reunited). The mother denied this allegation. Even if it's true, there is no direct evidence and M.A. Talamantes' tone in reporting that he believed everything the father had said was totally unprofessional. Judge Talamantes clearly had a vendetta against the woman. It was so hard to watch how he treated her--I eventually had to leave the court room. I have theories about why someone like him would treat a woman who has lost a child--due to his harsh interpretation of the law and abuse of power--in such a manner. Suffice it to say that I believe Mr. Talamantes could use some sensitivity training and a long pause from the bench.

I see Judge Mark A. Talamantes' position was to expire January 2021. Why is he still a working Judge?? This man is condescending and bullied me in his court. He sided with my ex who had a sexual affair with a co-worker subordinate. I had sent that woman an non-threatening, non-harassing email after I had seen the ex with another woman. The ex claimed I was putting his job in jeopardy. Neither he or the woman he cheated with would never disclose the email to anyone they work with. They would be incriminating themselves. The ex jeopardized HIS job when HE had the affair. The ex played the victim and he won. That judge put a 3 year restraining order against me. 3 years for an email that wasn't critical or negative. Judge Talamantes should NEVER have been allowed to have that position of power, as he has shown MANY times that he has abused it.

Rayyan told his father that he was being physically and sexually abused by his mother and maternal grandfather. Rayyan's father reported it to the authorities yet lost 100% custody without due process by a California Judge.
Rayyan's father, reported it to the authorities yet lost 100% custody without due process by a California Judge in Marin county. The judge used the social welfare department to overwhelm Rayyan who was clinging to his paternal grandmother when he was taken. The
grandmother suffered injuries during the ensuing struggle when Rayyan was ripped from her arms that required hospitalization.
Rayyan never got an opportunity to tell authorities himself about the abuse before he was forcibly taken by his mother.
We want Justice for Rayyan to allow him to speak to the authorities to tell his story!

I was a defendant in a civil action and the case against me was dismissed. Despite having won the case, I was shocked by Judge Talamantes lack of knowledge of the relevant law, his obvious bias to the person who had sued me(a lawyer) and his attempts to pressure a unfair settlement from me. I was not allowed to present my side of the case or call my witness. If the case against me was not completely and clearly baseless, Judge Talamantes bias would have perverted justice. Having been working through custody issues in Talamontes' courtroom for nearly 4yrs,I have to agree with 95% of the ratings on this judge. In my case, he routinely ignored my filings, refused to hear valid arguments, and did not seem to consider what is actually best for my children. In my honest opinion, Talamontes actually assisted in my ex-wife's campaign of alienating from my three children. He apparently has a history of unethical behavior in the Marin court system, and from my experience he should not preside over any family court cases.

That said, his demeanor in court is typically calm and professional. However, I stand by the above rating due to my many personal courtroom observations of this judge's work with other people.

This judge is unfortunately not the sharpest knife in the drawer. He is lazy and bias and he likes to shot from the hip. An unfortunate addition to the marin county court system and hopefully someone will run against this fool as his term is almost up. I heard that the other judges are ready to see him go too - because he creates so much work for them by not pulling his weight and making ridiculous rulings.
When you go to his courtroom you will find that woman loves him !!
This one has to go - hopefully by himself and soon.

I sued the Marin County Sheriff for seizing and destroying four floating fiberglass vessels docked on my dock system behind my waterfront house, by misapplying Harbors and Navigation Code re: Marine Debris. Judge Talamantes incredibly ruled that vessels that had just been transported over water for destruction were incapable of being transported over water and were therefor Marine Deris.

I'm a very fair grounded person, been in court as a single father in 2010 with a bias judge in SF it was unfair and bad for my son, 2016 a now gone from Marin judge was amazing, listened to both sides, allowed for evidence documents to be submitted, talked about in court, asked valuable smart fair questions made fair ruling ..validation, smart good for my son and for me ..mom didn't manipulate like she did in 2010 in SF..
Talamantes, notice I left Honorable off salutation...this judge is the most unfair, unprepared, biased, rude, condescending,mean family court judge one could get, he is tearing families apart I have no doubt having seen it first hand as a witness. The word "Honor" means to act with esteem with high distinction and with fairness to do what is right. this does not happen for families, parents, attorneys, children in his courtroom. He should be at most in night traffic court, maybe not even that. but he lacks compassion, fairness, preparedness, ignores facts from parties and court appointed professional mediators who's expertise is too make healthy recommendations on behalf of children..this judge ignores these things, he will not allow a voice or to submit important damning evidence to enlighten and inform him of facts which would benefit the children and deserving parents aginst manipulative undeserving parents..he truly should be censured, investigated (for conflict of interest bias and outright personal bias). If this is the best Marin could come up with god help all present and future families ..he has done an immense amount of damage in the family I know and I'm sure he has against many many others..I write this to have a voice in hopes that someone in a leadership position might see this and think..man we have to make a change, address this judge and transfer and/or remove outright from any position that requires open mindedness, kindness, empathy, compassion, fairness and so on. I can’t believe what I just witnessed and that this completely incompetent judge is behind the bench. He is completely arbitrary and basically clueless about people and pretty unhinged. Judge Talamantes is the worst judge. He's unprepared, doesn't review the files submitted, completely unfair. My abuser received a restraining order against me based on an email I sent to him. He's horrible as a judge! I have set in on 3 cases, so disappointing. This judge is never prepared, ignores an abundant factual details on the cases, always favors the female and all the staff knows it. I recently watch him give back custody on 3 yr old toddler to a mother who has been dx for mentally ill, severe eating disorder, alcoholism , drug abuser, multiple arrests, who recently attempted suicide a few months ago again !!! I can't believe he works in Marin county. His decisions destroy families. No common sense!! He needs to be put out to pasture.

Don't just take this from me, the rumors are true. Talamantes is not level headed and a crap shoot who will rule based on a personal, rather than legal, standpoint. Aside from ruling on law, a judge is a model that should show respect to the practitioners and litigants that prepare diligently to argue in good faith. Talamantes is no model. Notwithstanding his time on the bench, this jurist apparently lacks the minimum qualifications to do the job. He has been assigned to the Family Law division after being distinguished as the only judge ever to merit a blanket disqualification from the Marin County District Attorney's Office. He has no working command of the rules of evidence and procedure and, seemingly, no interest in entertaining legal argument predicated upon them. He is apparently well aware of his inadequacy, for he seeks to obfuscate it with bluster and bullying. We find many newly minted judges who experience a rocky start. Fortunately, most are able to learn on the job and achieve some modicum of competence. That has not been the case with this judge and he has surely been around long enough to know better.

Did not read my response, filed on time. Blew off suggestions for a mediator and family counselor. Used a one column ledger to weigh allegations when three were necessary. And made a fateful decision for someone who was not present but was minutes away and at the very least should have put on a speaker phone. Capricious is right. I will add lazy, cruel and biased. Talamantes clearly lacks any knowledge when it comes to family law and previous rulings of the appellate court. He was raised by a single mother and takes his "daddy issues" out on fathers in the courtroom. His extreme bias prohibits him from making any fair and equitable rulings.

Judge Talamantes is a horrible addition to Marin county courts. He is most often unprepared and confuses cases. He is one sided and fails to hear each side before ruling. It is often clear he has made up his mind before hearing any argument. Orders coming from his court often come to only one party and rules are not enforced, leaving the other blind sided by this judge. Families nor children are well served by judge Talamantes.

Judge Talamante’s behavior on the bench has raised serious questions concerning his role as a judge and exhibits a pattern of behavior that indicates an extremely blatant courtroom bias against pro se litigants.

The record repeatedly shows that Judge Talamantes often ignores statutory laws as well as the previous rulings of the Appellate Court and Supreme Court. Judge Talamantes often renders dishonest decisions that he knows to be devoid of factual or legal basis and is engaging in impeachable conduct. Recently I witnessed him deprive a trust beneficiary from filing objections in a probate matter because he asserted that the case was taking too long. When the beneficiary asserted that she had a right to file, Talamantes retorted, “and I have a right to hit you with sanctions.” As an attorney you should also be careful in front of this judge. He often fails to read the parties' pleadings and will simply rule in favor of the side he feels is more reputable or less likely to appeal.
