Criminal Defense Lawyer

Biased. Opinionated. All the qualities a judge should NOT be.

Comment #: CA6207
Bias. Unfair. Opinionated... all the things a judge should NOT be.

Comment #: CA6201
If you have the misfortune of drawing this straw, start planning your appeal. Clearly biased in favor of government. Case was decided before entering the courtroom. Postured theories that had no basis in law. Blindly defensive when you point out his fabricated theories. Thankfully, the appellate court saw the error of his ways.

Comment #: CA5500
Insecure. Fails to listen past surface gloss arguments. Vacated on appeal.

Comment #: CA5185
Clearly made up his mind before even hearing the case. If you get him, start planning a writ or your appeal. He wants to be an appellate judge and will do nothing in the name of fairness. He will do what the establishment wants so he can become his dream of being an appellate judge. He flat out misinterprets the law and leaves important info out of his decisions in order to make sure you lose the case. He is gay so your only chance of winning is if your client is gay and there was a cause of action that hurt your client. Always bias and pro management, pro big corporation. Who ever has the most money wins in his court room.

Comment #: CA5183
He already has his mind made up prior to hearing entire case. Very finicky. He appears to be interested, however that is only an appearance. I don't trust him as a judge.

Civil Litigation - Private

Comment #: CA4932
He is smart, conceited, and deferential to his law clerks in most cases. He prejudges and is impatient, but gives the appearance of fair-mindedness.

Court Staff

Comment #: CA4744
He likes good looking men and hates women! He removed three mothers from their children, the day that I was in his courtroom, and the dads got custody!

Civil Litigation - Private

Comment #: CA4581
He has a marked bias in favor of governmental entities -- to the point of fashioning theories on their behalf. Although he will listen patiently, and does read the papers, this judge is an advocate, not a neutral arbiter. In order to support the decision that he wants to reach, he will rely on patently inapposite cases.

Number of days my cat has practiced law in a private civil law firm: zero. Number of days Judge Lavin has practiced law in a private civil law firm: zero. Neither is qualified to judge civil controversies.

This judge is highly intelligent and well-prepared. He is overworked, so he does not take sufficient time to study the issues carefully. He is also very opinionated -- once he forms an opinion about an issue, he cannot understand his own errors when they are pointed out and will become defensive, so he loses objectivity in his defensiveness.

Civil Litigation - Private

Comment #: CA3404
I felt that he was thorough, really considered the facts and the law before him, understood the issues well even though it was outside of his usual area, respectful, and gave all sides plenty of opportunity to state their case. I feel like he was a little pro City/defendant. We were the opposing side and we won, but it should have been a slam dunk anyway because the City's position was extremely weak. Really.

Haven't a clue what CA2363 is talking about? He came across as intelligent, judicious, and confident of his abilities. I know Central District pretty well and this judge is nowhere near 170.6.

This judge should be removed from the bench. He outright lies on the bench, you will never get a fair hearing from him on anything. He's in the pocket.
