Sat in Eric Nakata's courtroom on Nov. 22, 2016, as he took on the role of prosecutor in questioning my husband during an inter-county transfer. Judge Nakata asked my husband for his address, which was in conflict with one the probation department mistakenly listed on their report. A bailiff was preparing to arrest my husband when he handed his drivers license to a public defender to back up what he had stated. When we requested a copy of the transcript for another purpose, we noticed that a large section of the exchange between Nakata and my husband had been removed, and the wrong address was put in the mouth of my husband, who knows his address and has proof of it. There is a reason judges will not allow audio taping in the courtroom, precisely so judges can doctor transcripts to avoid prosecution themselves. Shocking, but not for San Bernardino County, given everything I have learned about law enforcement in this region.
