Judge Elfving is polite, considerate, and intelligent. I wouldn't call him a model jurist, but he's much more tolerable than some of the degenerate incompetents who are on the bench in Santa Clara County. One key note is that Judge Elfving _never_ changes his tentative rulings. There is absolutely no point in contesting them, so don't waste your time. You'd better make sure your moving papers or opposing papers raise all the key issues, because you won't get a second chance. Interestingly, Judge Elfving never looks at you while he's talking, but I don't have a problem with that because I'm usually looking at my notes anyway. It's obvious Judge Elfving is near retirement, which is unfortunate because he's fairly pleasant and reasonable.

Judge Elving has reached the point in his career where he obviously does not enjoy his job. His rulings on written motions seem based on research by a minimally qualified research attorney. His rulings on oral matters seem based on the state of the law in 1997, when he last practiced law. He never changes his initial rulings. He makes no outward effort to seem interested in the issues before him. He shows no sign of life on the bench. He does not even look up when speaking or being spoken to. The only time he rouses himself is when he feels he is not being given the respect he believes he is due. He has made a good name for himself in the past, but it is obviously time for him to retire. Santa Clara County needs judges that will at least pretend to care, not crusty white male oligarchs who care for nothing but their inflated self image.

In my experience at Santa Clara County Superior court - this is one of the few , very few!!! honest, thoughtful, and knowledgeable judges. He uses proven facts to made his decisions, not behind the door agreements, likes/dislikes and other corrupted behavioral patterns. Judge Elfving is the one who gave me hope that justice exists.
