The words "above average" don't appear in the Judicial Code of Conduct, and the purveyors of those terms offer no gauge of their meaning. A person who sits on the bench had better be "above average" by any meaning of the term, but that person must know the law and express herself rationally and courteously so that language as a means of communication might function, whereas curtness or irracibility prevents it from functioning beyond the level of a grunt, or a laugh prevents it from functioning beyond a junior high school level of thought. This judge has gone beyond the curt, irrascible, and taunting-meant-as-argumentative remark and not only in my experience. This judge is retiring, and she does seem in need of doing so.
