It took this Judge 2 years to rule after the trial was over and on several occasions she kept saying "I have never been appealed...and want to keep that."

In Landlord/Tenant Branch of Superior Court of the District of Columbia, judges may be sitting without a complete understanding of or attention to the applicable law, and they may be sitting with the hope of getting through their assigned week or day more quickly than the voluminous caseload would seem to allow.

I think that Judge Bartnoff must be a fine judge in areas of the law that do not involve landlord and tenant matters such as tort law, but I doubt that she is up to speed on the basics of landlord/tenant law, and I believe that she was easily swayed, baffled, and convinced by an attorney who regularly inhabits that branch, in particular one who knew better than to put his client under oath and who substituted his represenations for her testimony throughout his presentation of a new issue.

Please, Judge Bartnoff, if an attorney represents to you that his clients want nothing more than to "upgrade" their property, when they've already stated to a court that they wish to renovate the apartment and cannot do so while the apartment is occupied, please think about the law. Please make sure that the statute and the legislative intent are respected and that the adversary system functions. Constructive eviction by renovation is what the City Council specifically prohibited in the law it passed in 2006, with good reasons.

Top notch. Lost a trial in her courtroom myself, and while I think I would not have let certain evidence in that she did, she was fair about it.
