A little story about Tonya Rainwater: back in 1992, I was forced to flee my home with my two young children because of my alcoholic, glue-sniffing, abusive husband. It was on his second DV charge that I went forward with prosecution, where he was adjudicated guilty and given (at that time) the standard max sentence for batter spouse abuse: 6 months' probation, one anger management course and a few hours' community service. I was urged by my state victim witness advocate to seek a further restraining order against my husband, as during his sentencing, he made threats he would take our children and flee the state, as well as physical threats against me (yes, in the courtroom). Tonya Rainwater heard the protection order request and although she granted it, she gave him unsupervised, every-other-week visitation, despite strong protests from the state victim witness advocate. But Rainwater was persistent in that he should have his "father's rights."

We ended up in the Cocoa DV shelter, then quietly relocated to Palm Bay. Unfortunately, my husband soon discovered our location and proceeded to harass and stalk me. I also, to my horror, learned from my children that he was sexually molesting my daughter during his unsupervised visits, with her brother forced to watch.

I immediately reported it to the police and after investigation, a warrant was issued for his arrest. Unfortunately, before he could be apprehended in Rockledge, where he was hiding, he broke into my home, held me at gunpoint for six hours, then finally shot himself and me. Luckily I survived - he didn't. The phsyical and mental scars left from that incident for me are something I can carry. But there is no answer or excuse for why Judge Rainwater put my young children, and especially my daughter, in such danger. My daughter, now 27 and a strong, determined survivor, is currently preparing her own personal statement to Judge Rainwater on how she feels about what this criminally negligent woman did to her. It's been a long time coming, and I hope Ms. Rainwater will think about it for the rest of her life. I know I'm not the only woman whose rights she trampled, whose protection she gave less than a damn about. Florida as a whole has a long way to go in understanding and appropriately dealing with domestic violence. But for a female to so callously disregard the safety of other women and children is abhorrent. She should not be on any bench or serving the citizens of Florida in any capacity.
