Litigant

Comment #: FL7847
Rating:Not Rated
Comments:
The ONLY judge I have encountered who demonstrates fairness and LISTENED to all litigants (including me, a pro se) while asking tough questions. He was far from condescending or partial to me (he denied my motion for summary judgment stating that he believe there was “something more” than the facts presented

Other prosecutors may favor him. However, my experience has been different. I believe that judges who don't do fair research into a case before hearing it will fall victim to false witnesses who want to cause injustices to happen to one that does not deserve it.

I would also like to add to comment below (#FL6732) that I have never heard any attorney make a negative comment about Judge de la O. As such, it is very surprising that a couple individuals have posted terse negative comments; this judge's reputation is not controversial whatsoever - in fact, he is the one judge that I would expect everyone to agree on. I also strongly refute the statement about having a bias against female attorneys. I am a extremely assertive female, I have strong female friends who have practiced before him extensively, and have generally seen many female attorneys litigate before him. I say this as someone who is extremely sensitive to gender discrimination and have found many, if not most, male judges to have a gender bias to some degree. If anything, he is a jurist that a female attorney can really thrive in front of because he really doesn't treat individuals differently whatsoever because gender, age, or other demographic factors. I never felt any pressure to conform to any gender stereotype whereas my assertive nature can put off some male judges. He really doesn't express personal opinions, preferring for people to see him as the black robe only, but my best guess is that he is probably a feminist as the fair environment in his courtroom is a stark contrast to many others.

I practiced before Judge de la O here and there for trials and other matters years ago as a prosecutor. I never had the luck of being assigned to his division, but can say it was very prized by both prosecutors and PDs given his reputation of being an exemplar jurist. The following is my own opinion based on my experiences, but also consistent with his overall reputation amongst attorneys on both sides. He is one of, if not the most, intellectually gifted and curious judges that I have encountered during my years in criminal. I am not sure whether he has a civil background, but I could definitely see him presiding over complex and IP matters. He is also the epitome of ideal judicial temperament - he seems to have one mood which is calm. His expressions and comments are always very neutral. He doesn't smile much (nor does he frown), but he is still approachable and exudes good character. He is patient and accommodating, but also efficient and rule-oriented. He is very fair and doesn't have any particular leaning. As he is still quite young, I would expect him to see him elevated as he is undeniably suited to being a judge and exceptionally talented. We have many troubles in this world, but judges like him make me feel better about our institutions and future.

Comes across as somewhat weak and insecure as a judge, though he has been on the bench a while. This appears to affect his rulings. Doesn't prepare before hearings so he does not know what is coming before him on regular motion calendar. Appeals to have a bias against female attorneys. It appears if he doesn't like a litigant you can't get a fair result. Also has no presence.

He just took the bench, but the whole criminal justice building is abuzz with what an excellent job he is doing so far. He is very fair, and neither pro-defense nor pro-prosecution so far.
