The State of Florida should be Embarrassed of this Judge. She doesn't represent her role as an officer of the court. She acts as an entitled goddess using her position of power to corrupt the laws of the State of Florida through her misconduct for her own personal gain. She creates disorder and a hostile court room and fails to protect the civil rights of litigants and public abolishment of defense counsels. Highly unprofessional and unable to have order in hearings. Request immediate removal and charged with the crime of harassment.

Hello Florida Judicial Misconduct Board,

I had the opportunity to review in its entirety the Parkland Shooter case with Judge Elizabeth A. Scherer presiding.

During the case, I witnessed almost unbearable unethical violations downright allowing bullying and harassment to exist in the courtroom. I would like to include Judge Schere behavior directed toward the defense team-PDO that was almost unbearable to watch as she engaged in verbal assault when the PD counsel remained calm.

Many of my contacts from around the globe also followed the case and agreed to the same conclusions that this case should spark an investigation with the World Human Rights Organization and the State of Florida. During testimony from family members of victims directed toward Mr. Cruz and his Defence, Judge Scherer allowed the families to use vulgar intimidating language including one victim's father giving the middle finger to the defense team.

Judge Schere had every opportunity to object due to the rules of conduct and should have held the victim's father witness in contempt of court for his actions. Nevertheless, Judge Schere's only response was that the families of the victims were clearly upset. Understandably, the families of the victims may have been applauding at the verdict of the Jury, but still is Judge Scherer ethically responsible to maintain order within the courtroom and ensure both the rules of court and conduct are followed. The law states that any official who has the obligated duty to stop a crime of harassment and bullying to exist and fails to act on there duties is guilty of the same crime committed. Absolute Immunity for judges only applies to judges who perform within the scope of their duties. By allowing a crime of harassment and intimidation to be committed in her courtroom is a far cry from a judge performing her duties to the best of her abilities.

While I do not condone the defense counsel behavior of flicking off the camera. Court was not in session and the defense counsel has a right to laugh with the defendant regardless of the crimes he commited. Mr. Cruz is not a monster, he is human, and without regard to the crimes committed has human rights.

If the Florida Judicial Misconduct Board doesn't see the actions of Judge Schere refusal to act within the code of conduct and protecting the civil rights and rules of court, then I'm hopeful that the Human Rights Organization will take action against the state of Florida for allowing such maltreatment to exist. It is my recommendation that the State of Florida sets a principle that behaviors and actions in the court by Judges will not be tolerated. In no means should the judge receive a slap on the wrist. The misconduct committed is of great latitude and the recommendations to the Supreme court of the State of Florida should be dismissed from being a Judge and loss of Judge Schere law license in the State of Florida.

Lastly, I do believe justice exists and Mr. Cruz already said he was guilty of all charges. The jury decided, on Mr. Cruz sentence. We don't allow public lynching or persecution in our courts yet, Judge Scherer completely failed her duties as a public servant and officer of the Court. The entire world watched as Judge Schere completely embarrassed the State of Florida, Broward County Public Defender's office in its Kangaroo court. Very embarrassing and highly illegal.

Thank you for your attention to this matter.

Regards,

Alan

"Legal observers, many of them... lawyers, are saying much the same of Scherer’s decision to hug prosecutors [after a sentencing hearing]. Many described Scherer’s actions as “inappropriate,” “inexcusably improper,” biased, unfair, and bizarre."

"Florida Code of Judicial Conduct:
A judge “shall avoid impropriety and the appearance of impropriety” in all of their activities."

“A judge shall not allow, family, social, political or other relationships to influence the judge’s judicial conduct of judgment. A judge shall not lend the prestige of judicial office to advance the private interests of the judge or others; nor shall a judge covey or permit others to convey the impression that they are in a special position to influence the judge,”

"the judge was clearly wearing a robe in a courtroom hugging [the prosecutors]".

Neutral and unbiased? Hummm.
