Like his father was before him, Judge Gaertner has been elevated to the E. Dist. Ct. of Appeals.

Judge Gaertner is a good judge. His position on the bench presents him with new challenges that he is adapting to well. He is even-handed and listens to both sides.

Judge Gaertner was ignorant of fundamental elements of civil law and demonstrated a lack of interest in obtaining that basic information. These shortcomings led him to make a wholly unjustifiable sua sponte judgment that disregarded not only the law but also basic federal and state constitutional rights. The appeals court reversed the judgment finding that Judge Gaertner abused his discretion in several ways.
