Where do I start,
1. If you would like your grandmother, to decide your case, be my guest and pick her. Her mindset and thought patterns are not what they were 20 years ago, and most people who pick her as an arbitrator will hope for her 20 years ago but will get some who is older and has a harder time understanding complex situations.
2. A younger person can listen to a testimony and see crocodile tears, but a grandmother cannot and will feel sympathy. Furthermore, due to age, 99% might understand a testimony in one way, however, for some reason, she comes up with a different interpretation, that is completely on another planet.
3. She is pro-defendant to a fault. She will be biased toward the defense and let the defendants’ attorneys do whatever they want. Late submissions, not following her orders, and submitting additional repots is all fine with her. Plaintiff’s side will follow the rules, but defendants will get a get out of jail card.
4. If a witness is shown to have lied, made false statements, that can be overlooked, by her personal feelings toward that witness over the facts.
5. She may find the defendant harmed the plaintiff, but at the same time, she will find a way to blame.
6. The defendant will make a claim, the plaintiff will state how the claim is not true. For some reason when she writes her judgement, she blames the plaintiff, completely ignoring the comments made by the plaintiff, explaining why the defendant’s story is not true. Either outright bias, or forgetfulness. Something a former judge, and arbitrator should not have a problem with.
7. Judges/Arbitrators are supposed to be able to understand complex subjects and put all the different parts together, but when they allow hearsay, from witnesses, even though they state it will not be considered, they end up using it in their decision, indirectly have let it play an important part in making their decision, while not outright referring to it.
8. Arbitration is supposed to be cost effective and rather quick, but with the right defense attorney, she will let them do as they please and drag things out with depositions, and motion after motion. She will let them deliver new evidence that was not presented in time for deadlines and allows them all.
9. She has no ability to understand financial and accounting related matters, she will rely on faulty defense reports, and ignore plaintiffs, summary which cites the mistakes the defense reports make with real exhibits showing the backup to the corrections. She will not look at them, and instead claim the creator was biased toward the plaintiff. She will use the defense report even though it does not accept standards for accountants and forensic accountants.
10. She will accept a forensic accountant’s report, even though he states that he is not acting as a forensic accountant in the capacity of the report.
11. She seems to make her decision, early on, and when that happens, no matter how much information is shown to prove your case, if she isn’t open to your argument, it will fall to deaf ears. While the other side’s proof will be used to further her decision, even if you disprove their claims, she will ignore them, and find a reason to support the other side.

As an arbitrator she sure does show her age. Cannot handle complex subjects. Anything related to financial matters is struggle. She has knowledge about business or accounting. She maybe taking notes, but you have no idea what she is writing. She will follow the facts when she wants to, but will allow gossip and hearsay to come up in discussions. She will state both sides are equally believable, but will then rule in the entirety for one side. She will let counsel submit additional reports and evidence outside of her instructions, to the detriment of the other side. You may think it is a good idea to pick her based on this review, but she may end up ruling against you. Think twice before retaining her.

Judge klein is a disgrace to our great legal system. During the trial her desk was lined up with New York Met bobble head dolls. She would slap her hand on her desk just to see the doll heads bounce up and down. This judge is an Ass kisser for the Department of consumers Affairs. This is no justice in her court she is all one sided.This judge should have her Ass kicked off the Bench or even better she gets sick and passes on.
