Civil Litigation - Private

Comment #: NY8233
Rating:2.3
Comments:
Judge Milin is biased in favor of tenants to the point that landlords rarely, if ever, get a fair or proper application of the law.

The judge's arrival time to the bench is usually well after 930 and close to 10 or even 1030 a.m. Tardiness results in too many adjournments and backlog of court calendar. If the judge were in private practice she would be placed on probation and then fired if her tardiness continued.

Ignored past ruling of NY Court of Appeals ( NY Supreme Court)To reach the ruling she wanted to make . Does not like to make waves or rule on hard issues

She is an extremely liberal 60's radical, married to judge finkelstein also a 60's radical. Her temperament is fine and seems like a sweet lady. Her moral compass needs alignment. She is known to hit the bottle.

Comments:
Judge dismissed our case, which was brought again 7 days later and won as a slum dunk. She didn't even want to talk about the case or hear arguments, finding a way to dismiss it sua sponte. All because her law clerk put a sticky note on the file saying "something", but I would assume it probably read "counsel represents the landlord and doesn't want to discuss a settlement at all, he just wants him out. OMG a trial. DISMISS no matter what". She was sweet to other litigants appearing that day, but didn't like my client apparently (3 story retiree house owner) or me, and that is it. Bad experience.

The sweetest person you'd ever want to met. She can't, however, tolerate conflict or make hard decisions, two traits you kinda need as a judge. Would be much better as an MSW.
