Civil Litigation - Private

Comments:
The justice learned a lot of things from her many years reading sophisticated briefs and listening to excellent advocates in her courtroom, so I think she has a handle of how to behave or appear smarter than she really is. But age may have caught up to her. She is irascible. She assumes someone who is not from a white shoe firm is incompetent. She is also careless with procedure (like overlooking an affidavit of service sitting in front of her), facts (like what the motion is before her), and the law. She tries to cover up her legal mediocrity with her bombastic behavior in court. I feel bad having to write that about a judge.

Comments:
Intemperate and ignorant make for a bad combination. The scariest example of her ineptitude that I have witnessed came in an oral argument on a motion to dismiss. After ten minutes of argument, she began berating the attorneys because both of them had failed to submit detailed affidavits from fact witnesses, and how could she possibly decide a motion to dismiss without admissible evidence before her. When the stunned lawyers gently tried to remind her that the issue was a motion to dismiss (to be decided on the law), she blew up at them, accusing them of incompetence and not providing quality legal services to their clients. And this woman is a commercial division judge!

Comments:
It's been over ten years, and this woman remains the very worst judge that I have ever appeared before. Her incompetence is superseded by her overt bias. She is as nasty and as hostile as can be, and is always paranoid. This judge is in bad need of a full investigation. She is a total disgrace to the bench. It's a shame for anyone unlucky enough to have had to appear before her.

I was before her the other day, and there were about twenty Fordham Law students observing in the courtroom. She loves to grandstand. Wow, she has some temper! The respondent defaulted, and she kicked the can down the road instead of making a ruling. She had the nerve to tell me that my father's company wasn't worth anything, so I shouldn't be in the commercial division. Then she spoke to another judge about my case in front of me in the courtroom. When she asked for the other judge at 9:30am, she told his clerk to "just get him now -- pull him out of his courtroom." She obviously had no respect for what that other judge might have been doing at the time. She certainly had no respect for my deceased father and his life's work. She is a waste of human blood plasma as far as I am concerned. She should ride off into the sunset in her cherry-red Cadillac (which she parks illegally all over the Upper West Side).

Comments:
Very inconsistent; lets her personal feelings compromise her judicial demeanor. She shoots from the hip on rulings, and is either ignorant or biased on basic trial concepts. Very slow on pretrial motions, and even on defaults. Apparently unaware of the concept that justice delayed is justice denied.

Comments:
Justice Bransten worked hard in a medical malpractice Part of court for several years until 2011, then moved to a Commercial part. I assume she still works hard.
I found her sympathetic to malpractice plaintiffs but not soft on "street smarts" or on the law. She expressed disrespect for plaintiffs just as readily as for physicians - when she thought it warranted. Yet she remained patient and receptive in every appearance before her I've had (dozens, including a 3-week trial to verdict).

Comments:
Unfortunately, this judge is very plaintiff oriented. Judge Bransten can be disrespectful to physician defendants. She has a temper that can be quite problematic.

Comments:
She is not particularly bright, nasty in temperament and heartless, unfair and biased.
She has no idea of the heartache she brings about. She has no concept of domestic violence or complex family issues.
