This judge abused his discretion as a trial judge. Firstly, he treated me with disrespect. He refused to pronounce my last name the way that I pronounced my last name; which should have been the first evidence that he was going to do exactly as he pleased during this trial; irregardless of being just, Secondly, from my first objection, he unfairly characterized me as making multiple frivolous onjections. The fact was my objection was warranted in that the plaintiff's counsel claimed substantial brain damage in his opening statement when the plaintiff had never pleaded same in his Bill of Particulars, at his deposition, nor was there evidence of same in any medical documentation. This judge then went on to bolster plaintiff's counsel's misrepresentation by stating " the plaintiff might have substantial brain damage." This judge mocked me when I took exceptions. When I stated I simply want to makeu record, he mocked me and laughed with plaintiff's counsel , in front of the jury, and said, we have heard enough from you, trying to make your record. When I would stand to make an objection he would yell at me to sit down;when I day, he yelled at me to stand. He constantly allowed plaintiff's counsel to disregard the rules of evidence and would then rule against me even when the rules of evidence supported my position. He made a mockery of the jury trial system. He was clearly pro-plaintiff, as well as sexist. Out of my 23 years of being an attorney, he was the worst judge I ever came across, and I have been up against any tough judges . In the end because I challenged him on his abuse if discretion he threatened to hold me on contempt if I did not pay $2,500.00 to the Brooklyn Bar Association volunteer Lawyer's Fund. I had to hire attorneys to represent me, I had to pay $2 ,000.00 to get a copy of the trial transcripts. All in all, I spent $12,500.00 avoiding his contempt charge, my lawyers told me challenging a judge on judicial discretion was near possible, so I did not bring any charges against him. Being in front of this judge was one of the absolutely worst experiences of my life. I wanted to leave trial law, which I love, when this was going on.

Thinks he's smarter than he is. Couldn't get a small infant's compromise past him because he wanted physician affirmations for every imaginable injury.

This smart judge uses his talents to reach predetermined determination. You can't find more pro-plaintiff judge in the entire state of NY. He does not even try to hide. Shameful, full of agenda. Does not belong in this position.

After a more than three-hour wait, Judge Battaglia was rude to all counsel, insisting on oral argument with numerous papers having been served in the minutes before argument. He then had counsel wait while he read three paragraphs of a cross motion first (without having read any of the original motion papers) and then proceeded to attempt to "predict" his ruling (which he at least took on submission) with full intention of "finding" an issue of fact. It would have been far less rude to admit that he had read nothing, and/or adjourn oral argument to another date, rather than to insult counsel with his incompetence, unpreparedness and haphazard comments.

Judge Battaglia has taken a court's ability to search the record to new levels of stupidity. He finds issues of fact where he does not know or understand them. He does not contact the parties to determine what facts are understood as between them. If he does not understand the issue, he claims there is an issue of fact. Against both the NYS Constitution and the CPLR, he has determined that a Jewish person must declare that they are Jewish in order to affirm a transcript. This is neither required under the CPLR, which permits depositions to be sworn or affirmed, and violates the Constitution, which does not permit a court or party to inquire as to religion. He also finds obscure areas of law and misapplies those concepts to ordinary run-of-the-mill negligence cases. And, wrong as he often is, he loves to cite his decisions.

He seems to be very reasonable on the bench. But after you get a few rulings you realize that he is bizarre. He seem to be caught up in the minutia of the law, rather than seeing the big picture in the case.

This guy is nuts. Made our Atty resubmit multiple times the same documents and ruled against us with no oposition in a foreclosure. Overturned on appeal then never gives the decision until we threaten to sue and send him demand letters. Vito Lopez Brother in Law. Old School Italian Social Communist. Polical Hack. Donate to Ridgewood Bushwick Centers then tell him to get off you case due to conflict of interest.

HAS A BIT OF OCD; HAS A FEW UNIQUE THEORIES ON EVIDENCE; HAVING SAID THAT, A PLEASURE, EVEN HANDED, ISN'T ROOTING FOR ANYONE, TAKES AS MUCH TIME AS HE FEELS HE NEEDS TO GET RULINGS CORRECT; AND HERE'S A RARITY, WANTS, INSISTS UPON CIVILITY IN THE COURT ROOM.

An even-handed jurist with respect for lawyers who wasn't afraid of calling out the City's obstructive discovery tactics when he used to run the part. I respect him for his lack of bias, even though he regularly spent extensive time with them in the City part. His decisions are well researched and always made in good faith.
