Judge Silver comes across as being quite jovial and caring. His jovial manner however masks a legal wishy-washiness, unpredictability and/or lack of care. Each time I have appeared before him to argue a motion, he never seems to hone in on the actual issue(s) to be decided but instead pontificates, often inaccurately, what he believes the issue to be. He makes snap judgments and then proceeds not to listen to the litigants even though he is often on one page and both litigants are on another. Furthermore, despite the fact that he handles all the motor vehicle accident cases in NY County and has a huge volume of cases, he is highly inefficient. While most other similarly situated judges make ample use of short form orders, it does not appear that Judge Silver does even though at least in my experience, many if not most of the motions he handles could and should be resolved by short form orders. The result is that his decisions tend to be equivocal and/or are handed down months after they are argued resulting in needless delay among other things. The question remains whether Judge Silver is merely disinterested or simply not competent to be a judge.

Judge Silver talks with a dual face. One time he was kind and spoke and was even very helpful suggesting what to show the court with regards to tangible evidence. Then on the next day, I thanked him for his advice and he stated: "I never gave you any advice; that's not my job." I believe that he is bipolar.

Judge Silver is one of the most understanding and fairest judges I have had the experience of conducting a trial in front of, and the bench needs more judges like him. As a former practicing attorney he has a unique understanding of the challenges that most trial attorneys face while preparing and conducting a trial.

I dealt with Judge Silver when he was in private practice. He was a gentleman whose word was his bond. He was always professional and intelligent. I was happy to see that he brought all of these qualities with him to the bench!

I have met several attorneys who have made their way to the bench who have turned out to be complete disasters. This Judge is not one of them. He handles the TAP part clean and neat, treats the attorneys as professionals and knows how to get a matter settled where appropriate. At trial I have gotten overruled and sustained where appropriate. On bench trials he is even to both sides. We need more like him.
