I had the pleasure of appearing before Judge Everett several times over the last couple of years for conferences and trial in Supreme Court, Westchester County. Judge Everett was courteous, respectful and thoughtful in all of the interactions. When novel issues arose, Judge Everett provided all litigants ample opportunity to present their positions before responding with well thought out and supported decisions. As a trial judge, Judge Everett was prompt and hard working. We were all able to move the trial along quickly due to his decisiveness and control of the courtroom. Every day in his courtroom was a pleasant experience! Judge Everett was also very attentive to the facts of the case during the trial and attempted to engage all parties in meaningful settlement discussions before, during and after the trial concluded. Judge Everett was persistent and worked hard to get the cases resovled in a manner that suited all parties best interests. I would definitely look forward to another opportunity to be before Judge Everett on another trial or court appearance.

I have appeared in front of Judge Everett several times over the years and I have found him to be a thoughtful, even tempered jurist, who is conscientious, thoughtful, and diligent. It is a pleasure appearing in front of him. Suffice it to say, we need more judges like him on the bench.

I had the pleasure of appearing before Judge Everett in March of 2018 on a serious civil claim which required a trial to lay the groundwork for a resolution. I had never been before Judge Everett but was very pleasantly surprised with his legal intellect and diligence. He certainly did not reflexively rule in my favor, and in fact I think more of the close calls went against me. Nonetheless, I found Judge Everett even-handed and understanding as only someone who has tried cases can be. I just happened to be awaiting assignment to a trial judge in the Bronx when I was alerted to this site. I started looking up judges who I had recently tried cases with to see how the rest of the Bar felt towards them. In coming across a couple of comments regarding Judge Everett on this site, I was flabbergasted. I don't generally share my opinions about legal colleagues but I felt that the negative reviews of Judge Everett were beyond unfair and completely at variance with my experience which includes in excess of 50 civil trial verdicts and countless other cases resolved by other means. Anyone who gets Judge Everett for a trial assignment should be at ease knowing the court will handle their case in a totally unbiased fashion.

Comments:
I have appeared before Hon. David F. Everett on multiple occasions when he sat as a Judge of the Westchester County Court and more recently, as a Supreme Court Justice. Judge Everett is one of the most intelligent and thoughtful jurists in the court system. He spends whatever time is necessary to provide litigants with their “day in court”, listening carefully as they convey the facts and circumstances of their case, and he often tailors a decision specifically to address the parties’ concerns. He is always patient and respectful of all parties and their counsel. Thus, I was astounded to read two reports which are critical of him and I can only imagine that their mischaracterization of his character and of his service is the result of a decision against them.

This Judge, now a Supreme Court Justice is excellent, well prepared, and has a gift for dealing with jurors, litigants and attorneys. As an attorney admitted more than 40 years to the Bar, Justice Everett,a decorated war vet, is among the best jurists I have practiced before.

Atrocious judge! “Clueless Dave” should be his new name. He truly knows little about the law. He couldn’t care less if he is screwing a litigant for life. As long as he clears his calendar. The law doesn’t apply with him. He’ll have ex parte discussions and has very little knowledge about ethics. He’s personally a nice guy, but should stay far away from the Bench. The only bench he should sit on is the one at the park while feeding the birds when figuring out how to interpret the law.

Not a judge; the law is secondary & the facts irrelevant. This guy should never be on the bench. He (and his law secretary) work diligently toward a pre-determined result, rather than letting the law and facts unfold. Mediocre intellect and deferential to government
