Justice Gische acts with unfounded arrogance. Her Honor insisted during oral argument that I could not enforce the delegation clause in an arbitration agreement, because I was claiming a right to rescind the arbitration agreement containing that delegation clause. However, a delegation clause is severable from the arbitration agreement containing it (Rent-a-Center, West v. Jackson, US SC) and one of the main consequences of severability is that a party can rescind one portion of a contract whilst enforcing the severed portion. If the First Department, Justice Gische included, took the time to write properly reasoned opinions, they would likely see the flaws in their own reasoning more often and make fewer obvious errors.

Hey Judith Gische my daughter is now 20 years of age!! and thanks to your decision she has nothing to do with me had a troubled life and I still had supervised visitation with ever given a reason or trial for supervised visits. Maybe you and Stephanie Rancer where to busy stealing from the State to give the law guardian money that you forget to "think" and ask "what about the child"?
May your life always be looked and frown upon your an evil woman and deserve no luck!

There is no rating for a women in black who doesn't do her job as the job responsibility is noted for. She makes her decision based on cronyism, favoritism,and corruption(Gerald Garson)
She does not read moving papers let alone when the witnesses are giving testimony. She sits behind her computer and hides.. Is she also a court reporter?? She has ruined many peoples lives as well as children....one being mine! She left my daughter with a full blown narcissistic...Had she read her own appointed forensic report she would of known this. She may of even left children with full blown batterer.. Iam disgusted with the judicial system!! what a shame!!I wonder how much she paid off someone to get to the Appellate

Obviously after her decisions in the Giuliani divorce they took her out of Matrimonial but kept her in NYS Supreme.
Small claims arbitrator would have been a more appropriate assignment.

Does not read motion papers. I had a case involving proof of payment, and had cancelled checks to prove it, but she only listened to the attorneys argument and did not read the papers. Decided the motion without looking at the papers at aii!

She watches her lap top will conducting a hearing.She doesn't look at the facts.If she has issues with a litigant be careful cause her decision is based on her personal opinion and not that of the law, She couldn't do matrimonial so they took her off the bench and stuck her in general. Gerald Garson and her belongs together!

She does not have a good temperament. She gets irritated and angry very easily, and one senses it is due to her not having a very high intellect. Out of confusion and lack of understanding flows anger. Also, she has little interest or understanding of the deposition rules and how to enforce them.
