Civil Litigation - Private

Rating:1.0
Comments:
Justice Vaughan is not interested in your problems. He is a sloppy and careless justice whose errors often compound problems for the parties appearing before him. Many of his opinions and orders are rife with fundamental errors of procedure that he has no interest in correcting, and which cause legal bills to multiply when lawyers must spend endless hours attempting to repair the damage caused by his rushed and amateurish work. Does not answer the phone in chambers; court officer does not provide information. Makes you pine for trial by ordeal, which would at least be more predictable, scheduling-wise.

A concerned and fair jurist. Cares about the cases that are assigned to him and runs a well organized and efficient part. It was a pleasure to appear before him.

Rating:2.8
Comments:
This person has lost all desire and enthusiasm with regard to functioning as an effective jurist. From the outset he displays uncalled for disdain for attorneys who appear before him. He makes no effort to coneal his unhappiness about being given a trial assignment. His demeanor before the jury is one of impersonal apathy. During trial he outwardly huffs and puffs; and moans and groan in front of the jury. He should not have received certification, as he is consistently cranky and despondent.

He is a terrible judge. He decided an MSJ within thirty seconds, without having read the papers.

I would sum up Judge Vaughan in 6 words:
"lazy, stupid, and hates his job".
He works two and a half days a week, reads the newspaper on the bench instead of listening to the evidence, and makes stupid faces in front of the jury. He should do us all a favor and resign from the bench.

He is a disgrace to the profession. I just appeared in his motion part with 40+ motions on. I heard he was running late. He apparently planned to be running late b/c he had decided all 40+ motions the night before with short form orders. His law clerk told everyone no adjournments or additional papers would be allowed. My complex motion got a one sentence denial. He existence makes a mockery of the profession.

Comments:
Not very bright or industrious. Had him on a rather complex civil matter (not a personal injury case). He didn't grasp the legal arguments and had no interest in understanding the law involved. Really soured my client on the legal system. His law clerk was also dismissive and generally nasty.

My experience with Judge Vaughan is that of an intelligent and considerate man. In addition, he is one of the most productive judges in Kings County.

Comments:
He is defendant oriented because he is jealous of the money they make as he knows he never could have made it as a plaintiff's lawyer--Have seen him at functions and he drinks like a fish. And yes, a truly bad bad guy.

Judge David B Vaughan is extremely arrogant rules on his emotions, his court room is bias, may god help who get this judge on their case

Comments:
Judge Vaughan obviously read carefully voluminous motion papers in my case. His questioning at oral argument and his ruling on the motion showed that he had a firm grasp of the issues and a sense of justice. He is no shy about letting you know what he thinks, but is also open to persuasion. Essentially everything a judge should be.

His title should be DIS-Honorable Vaughan. He is a disgrace to our legal system! He reads the Daily News/Post while witnesses are on the stand. He was reading The Masters of Golf while the plaintiff was giving testimony! When asked to make a ruling on an objection he became irritated replying "What? What? What is the question?" He is impatient with the Plaintiff's entire part in the trial often interrupting- like a spoiled child- asking: "Are we done yet? Let's go, counsel. Ok, Ok, we get it let wrap this up".
He was drowsy in the afternoons and actually fell asleep during the trial for 6 minutes! He is Definately a Defendant's judge. He makes noises (sighs & sucking his teeth) & rolls his eyes when valid points are made on the plaintiff's behalf. His ONLY interest in the Court Room is the clock! He watches it like a hawk...if he is dying to get out of the court room so badly, why doesn't he do the great County of Kings a favor...and...GO!

Probably the worst trial judge in thirty-some years of trial work. Arrogance and ignorance in equal measure.

If reading the newspaper during a trial and sarcasm were Olympic events, Judge Vaughan would win a gold medal.

Why doesn't he just retire already? An uncaring judge who would rather be elsewhere.

I pity the ones who get this judge; he so far from being fair it is incredible that he is a judge. If he doesn't like your case he will let the jury know it through gestures, facial expressions and rulings. Truly a horrible assignment and awful judge to have on a case. In the end it is the litigants who suffer.

Justice Vaughan was once asked, "Which problem in our judiciary is larger: ignorance or apathy?" His response was, "I don't know and I don't care." Just an awful assignment.

The worst judge I have ever appeared before in 25 years of civil trial litigation (plaintiff). A defendant's judge and makes it known. Reads the Daily News while plaintiff's experts are on the stand. Rolls his eyes when plaintiff does something that helps his case. A miserable, uncaring judge.
