This judge has a good temperament on the bench, and will let all parties have their say. He knows the basics, but he is not willing to give much thought to more complicated issues. He regularly obstructs legitimate third-party discovery by interjecting his own, biased sense of what type of discovery is allowed under the CPLR. I have seen him encourage plaintiffs to go on a discovery "fishing expedition" for evidence that might support extra-contractual damages, while in the same case, he barred the deposition of a third party who was directly involved in negotiating the contract because he thought other discovery should be done first. He also appears to favor plaintiffs. He might be acceptable as a judge for slip and fall cases, but it is absurd that he was put in the Commercial Part.

Took over a complex case and handled a multitude of issues well. He was a breath of fresh air. He was smart and had studied the papers on various motions before him.

Why this man is a judge is a tribute to the political forces, not skill. And because of that he thinks he need not work. Instead schmoozing got him where he is and where he will stay. The guy is on board of Jewish Lawyers . What because he is Jewish? His "friends" protect him. Nice job if you can get it.
