Comments:
Judge Whelen is excellent. He allowed my client to see him on the last hour of the day and ruled fairly. He recommended that his case involving a release of petroleum cleaning fluids at residential address at 74 Hilltop Drive, Sound Beach, NY at Scott's Beach Community be reviewed by Eastern District of New York. One of the best judges ever.

How can Justice Whelan rule over a foreclosure court, when he has openly written an editorial for the NY Law Journal (easily found online) against the 1303 and 1304 RPAPL protections, amongst other laws, enacted after the 2008 crash to help borrowers? These are the laws of New York State, and a man ruling on them has written an editorial against them. How can this be?

Justice Whelan in Suffolk County is in charge of a foreclosure part which virtually never denie a Judgment of Foreclosure and Sale. Show me more than 5 he has denied, if they exist. Justice Whelan is pro-lender, anti-borrower. He seems to be there simply to clear the foreclosure docket in Suffolk, rights of the borrower out the window, and with each decision on Judgements of Foreclosure and Sale, he finds for the bank. The borrower protections put in place in 2009, specifically the 1303, 1304, and 1306 RPAPL notices, mean nothing to him and he routinely disregards them, as does his associate Justice Howard Heckman in another foreclosure part in Suffolk.

Comments:
In a case where the home was purchased from Suffolk County as a town tax foreclosed property. He let a bank take it back to sell it. 10 years after the bank lost its rights to the home. In my opinion he is Biased and I influenced by a prejudice against a home owner. He does not follow the code which is his job and needs to be sued.

Comments:
Justice Whelan harbors great disdain toward the disabled. The entire proceeding was filled with mocking disabilities in general and personally too. I was unable to appear but when I got the file I could NOT believe the sarcasm. It is disgusting that this is allowed and accepted- there is no accountability.

Would find a way to foreclose on a ham sandwich if a bank brought the action. Refuses to follow the RPAPL borrower protections of 1303 and 1304 put in place after the 2008 real estate crash. He even wrote an editorial against those laws, but still presides over a foreclosure court in Suffolk. Fox guarding the hen house.

if you walked into his courtroom with a satisfaction of plaintiff's mortgage, he would still find away to foreclose. Incredibly biased.

Judge Whelan is a wolf in sheeps clothes. He has demonstrated racial and religious bias against me and my client. He is spiteful and will smile in your face while stabbing you in the back.

He is not strong on the law and he harbors resentment that he will never advance within the court system due to his DWI and domestic abuse history.

This judge is honest and smart. His decisions were right on the mark for facts in the case. If he thinks he does not know law, he is honest enough to say so and does his research.
