Judfe Diccia Pineda-Kirwan in her decidions acknowledged my easement or right of way to access the Atlantic Ocean was assigned forever as recorded in the deed by the grantor. She always sat on the fence and never made a decision that favored the right of way which was already decided by now retired judge Dollard. He determined that the developers encroached upon y right of way and in his decision the case law provides that thesbuilding should come down.

Well, I went back to court and got Judge Pindda-Kirwan and her wonderful law clerk after many motions she could not get rid of me since I was a pro se and did all the work and briefs and motions my self. So she decided to go against the law and terminated the right of way. What kind of judge is she...HUM????

She is not a Judge but a political appointee or was voted in--WOW.

We need judges that rule according to the law and the CPLR.

Instead of deciding motions within the time frame of the CPLR after a motion is marked fully submitted in the CMP, this judge issues an order setting the motion down for a conference. She uses that order to make it appear to OCA that the motion has been disposed, when it has not. The settlement conferences, per the orders, are set for 10 am. You show up, tell one of her law assistants about the motion, watch the judge show up at 10:30, put your appearance on the record, and then tell her other law assistant the exact same thing you told the first law assistant. If the case cannot or should not be settled you will be kept there until at least 3 pm as punishment. This happens on every motion assigned to her, regardless of the type of motion, even if it's an unopposed motion for consolidation. In one case, plaintiff's counsel had an elderly client and moved for summary judgment on liability, thinking that would get the case moving faster. Instead, we had a conference with each law assistant, explaining to them that even if the carrier would offer nuisance value plaintiff would not and could not accept it. Further, because the SJ motion was pending, we couldn't proceed with discovery because plaintiff's counsel did not know if the SJ motion would be granted, so he could not submit his client to answer questions on liability and it was now far beyond the 60 day statutory time limit. This judge may think she means well but she has no idea what she is doing and simply should not be on the bench due to her utter lack of judicial temperament, complete unabashed bias in favor of plaintiffs, and total disregard of the CPLR and Uniform Rules.

How do people like this get on the bench? This judge is an absolute disgrace. The simplest of motions with no opposition, and you are there for no fewer than three and a half hours. The word incompetence doesn't do her justice. And those poor interns she trots out there: what could they possibly be learning?

I'm 51 years old and have been a practicing trial attorney for 28 years. Today, September 19, 2013, I had the displeasure of encountering the worst judge I've met along those three decades. A despicable exemplar of robe-shrouded insecurity and ego-driven petty vindictiveness.

It's now 1:15 and I'm still being punished, sent to the corner, for not walking in with a claims rep from west of Cooperstown on a threshold motion that should have simply been decided following full submission months ago.

Instead of deciding the motion, she ordered today's "Settlement/Motion Argument Conference" -- a strong-arm tactic to try to wheedle nuisance value from a carrier that has quite properly taken a hard no-pay posture towards the mother of all non-threshold actions, and relieve her of her obligation to do her job. Carrier rep called, can't make it, but this judge refuses to adjourn to another date or reserve decision on the substantive application.

No, I have to sit here all day because I didn't cower in the face of her abuse before a full gallery, but used my on-the-record response to show the non-pragmatic foolishness of her prioritization of form over substance. My adversary and her client must also waste their entire day, on a case that will not settle even if the MSJ is denied. Rude. Small. And, most of all, stupid.

Despicable. Denied a request by my adversary for an adjournment, with my consent, despite an extremely compelling personal family emergency, and then bartered with the attorney to agree to bring in an adjuster in return for adjournment. Short tempered and clearly not above resorting to beyond contemptible conduct. Absolutely awful judge.

Really bad an Order to Show cause sent to sat there for almost 4 weeks and when contacted did not want to be bothered in chambers and clerks in her part claim she has 60 days for ruling on OSC. Definitely does not have a clue.....

This Judge needs to be removed she is really terrible and should not be a Judge as she has no clue what the heck she is doing!!! Her discission do not make sense and she seems to want to reject and deny all relief eithier because she is just simply not getting the point or wants Attorneys to pay the fee over and over again. She should of spent time as a practioner this may have helped her but as it stands she just is not fit to be in a postion as a Judge in the Courts of New York.

The absolute worst judge in Queens. Another political hack who got the job through connections. Never worked in the private sector and has no idea what it is like to practice law. Absolutely no judicial temperament, horrendous work ethic, no concern for the time of the attorneys before her or the added cost her shenanigans are costing the litigants. And to top it off, she is not very bright. As previous posters have said, she dismisses motions that are not noticed for the LIC court. I commenced an Article 78 proceeding in Queens which, after filing, was assigned to her. Since the petition is brought before a judge is assigned it was noticed for Jamaica. Even though the defendant’s attorney appeared and consented to jurisdiction she dismissed the Petition. Tried to explain this to her, but she accomplished her goal (disposing of the matter without doing anything) and would not hear it. I renewed the motion and after 3 appearances in front of her, each of which took the entire morning, the matter is now submitted. Hopefully it goes to the law department for decision!

A horrible judge. Calander call is at 11:00 a.m. But she is so slow that most attorneys must return after lunch. A total waste of time. She is a lunatic about motions. She will ignore the law and dismiss a motion because of "improper" notice, even if opposing counsel stipulates. She should not be on the bench.

She has this thing about the notice of motion being perfect, despite applicable law (see comment NY2486). Furthermore, she had the problem despite no opposition from opposing counsel.

I definitely agree with all of the negative comments that were posted before my review. I am utterly shocked that such incompetence and unprofessionalism could be tolerated, no less promoted. One of my experiences before this Justice was where she relegated my motion to the defective pile because she did not see the service list that is supposed to appear after the signature block on the notice of motion. My attemots to explain that it was there but that it was on the next page due to a lack of room, were an exercise in futility because she refused to turn the page to see it. Disgusting!!!

This judge has managed in her brief tenure on the Supreme Court bench to hit the trifecta: her temperament is meanspirited and petty; her grasp of legal and factual issues and intelligence in general is virtually non-existent; her work habits are abominable. Essentially, her modus operandi is to do as little work as is humanly possible. This results in the elevation to near-religious status of the concept of form over substance. Thus, for example, motions brought before her which are noticed for the Jamaica courthouse are immediately relegated to the "defective" pile and forced off the calendar. Thus, motions for summary judgment are rarely, if ever permitted to be submitted for decision since that would entail this judge having to actually do what she is paid to do, that is, to make a decision. Thus, attorneys are routinely punished into staying into the afternoon because they refuse to back down and withdraw their motions or have the temerity to stand by their arguments and not stipulate to resolve substantive issues at hand. In the face of criticism, this judge retorts that "the people elected me;" sadly, as good an argument as there can be made to do away with the travesty of electing judges the average person knows nothing about.

It leaves one speechless that this woman is a Supreme Court Justice. Her calendar call is a disorganized free for all. She manages to be tyrannical and clueless at the same time.
She expends a tremondous amount of effort scouring pleadings for a reason to dismiss them so that she doesn't have to do the job for which she is paid.

Pineda Kirwan is unfit to be a Judge. She is a disgrace. As another poster stated, her antics are unbelieveable. She has gone through about ten court attornies and seem sto be mentaly unstable. The fact that she was promoted to Supreme Court makes me want to vomit.

One of the worst judges in the history of Queens Civil. Historically bad. There are so many horror stories involving her and her antics, there isn't enough time or space to write them here. She has a terrible judicial temperment, she is not intelligent, she has no grasp of the most basic issues of law in front of her. I am baffled that she received some positive feedback here. She probably wrote it herself or made one of her many court attorneys do it for her - she's gone through at least 10! Sadly, this woman was rewarded with a promotion to Supreme Court. They immediately banished her to Long Island City where she will hopefully stay for many years to come. I wouldn't want to appear in front of her for a traffic ticket, let alone something of significance.

This Judge is steeped in the law, extremely thorough, and demonstrates a curiousness that often leads to relevant inquiries. She is tough but fair and her demeanor is outstanding. Always prompt, she knows attorneys have schedules too. She is a credit to her profession. We wll miss her in Civil as she just received a well deserved promotion.

True definition of a biased hack. Never worked a day in private practice. Married to someone(she'll tell you herself) which was her hook into the ladder. Does not want to work - in motion part she used to force you to wait until the end of the day if you didn't stip the motion out. In other matters she would refuse to so-order settlements agreed upon between the parties unless the numbers were changed(usually in favor of the defendants).
