I just read another rating. And experienced exactly the same thing. Definitely LL friendly. Refused my attorneys request for video tapes the LL said I was on showing me harassing fellow tenants. Of course I wasn't on them, so the LLs attorney said we were just "fishing" and Marton let him get away with it. Who, in their right mind, that has visual evidence would not want to show it?!
LLs attorney bullied me on the stand. Marton would cut me short when I answered, yet let LLs witnesses who were employees, go on and on and even asked them questions.
My attorney asked to subpoena records that would help me prove my case, and again Marton refused.

It's lucky I made sure I had quite a few witnesses who had nothing to lose or to gain. Otherwise, I believe Marton would have ruled against me.

In the end, his decision went through all of LLs witnesses and gave only one credibility. Never mentioned my witnesses and their credibility, so if someone looked at my case, they wouldn't see my side!!!

He should be taken off the bench!!

Biased judge. Clearly favors landlords, even the ones who blatantly lie under oath. Written exhibits crucial to a holdover case, not admitted into evidence.

He allows the unethical landlord attorney to grandstand, waste time and attempt to bully witnesses. Meanwhile during trial he wouldn't allow the respondent to finish answering the questions they've been asked.

Surprise, surprise Marton rules in favor of the landlord and his attorney in his decision. He accepted all of the landlords evidence and ignored all of the tenant's evidence. The respondent presented 3 witnesses and all their testimonies were disregarded. All in all, a complete miscarriage of justice.

Gary Marton should be removed from the bench before retirement.

Judge Marton's decision on an illegal lockout case rested on his hunch/instinct, rather than on the Law,documentary evidence and sworn testimony of the plaintiff. The matter lasted from Feb. 14, 2018 until May 18, 2018. Two of the three witnesses who testified for the landlord, 86 BayLLC, directly worked for him. One witness testimony was self serving, because his goal was to have his brother from Apt. C5 move into Apt. A7 once it was vacated through J. Marton's decision. The third witness was from the Guardian of the deceased primary tenant of record, who mind you was removed from the case for misconduct, came to retaliate against the brother who was seeking succession rights. Judge Marton was partial to the landlord from the onset, and the evidence that supported theplaintiff's case was totally ignored. I hear he is retiring by June, and by so doing will do the public a lot good.

Incompetent, partiality, unorganized, forgetful, does not follow through on his own orders. Psychologically intimidates and persuades litigant to proceed in a fashion that they made clear was not there intention.
Worst judge I have ever witnessed.
