Don Cosby is a Judge who really cares about people. He is fair and willing to give guidance to those of us who are just trying to get justice.

This judge throws the rule book out the window more than any other I have seen. I forced him to produce the Court's phone record under Rule of Judicial Administration 12. He refused, I appealed and latter a Per Curiam Rule 12 Decision ordered him to produce the records. The phone records proved what I suspected, a shocking amount of ex parte communication with the opposing PARTY and his counsel. Dozens of calls placed by the Court to the private cell number of the party. Many of the calls took place on the mornings before a scheduled hearing at 1pm. Cosby is influenced in some manner. Like a previous comment here, the judge does not have a good grasp of the TRCP and he is dirty.

Is not familiar with the basic rules of evidence. visibly makes faces in front of the jury to express his judgment for one side or the other during testimony. gives great sighs from the bench in front of the jury to evidence he doesn't like. Does not have a good grasp of the TRCP or TRE, especially impeaching on prior inconsistent statements

Don Cosby generally tries to get it right. but, he will make an alarming number of errors in his interpretation of the law which will exclude key evidence or cause witnesses to avoid using phrases. It's an annoying way to try a case, but the trial is still fair. He is not a big student of the law, so be prepared to play the role of teacher.
