First and foremost, I will admit that Judge Schubert is a brilliant legal scholar and that his knowledge of the law is vast. Unfortunately, he is the type of Judge that needs to make sure everyone knows that he is the smartest man in the room. Additionally, this often seems to lead to Judge Schubert making up his mind in a matter, based on his own preconceptions of the laws and facts, well before a matter is fully presented; this regularly manifests itself in this Judge making his own objections for the party he pre-conceives to be prevailing, in the Judge eliciting testimony from witnesses himself, and in the Judge often injecting his own beliefs and arguments into the record. I have discussed this with several of my contemporaries, and this does seem to be a reoccurring concern with this Judge. Effectively, if you are able to make a good first impression with this Judge, it will likely carry you to victory at trial; however, if you have any indication early on in the action that this Judge is favoring the other party, it is likely that he has already made up his mind and that it is not likely to change.

Schubert is the reason the Framers incorporated the central idea that "there shall be no special privileges or immunities," which hopefully will soon be restored based on recent press coverage by Reuters and the Boston Globe. He is his own caricature of judicial arrogance, the consequences of unchecked judicial power and the abuse of public office. [redacted by Ed.] he has a long track record of retaliation. [redacted]

This judge is extremely biased and not impartial whatsoever. Frankly, it is shocking how one-sided he seems to be. He appears to be pre-disposed to one party, yet without having considered all sides or the facts. It is questionable whether he will be receptive to considering facts or binding precedent that is contrary to his pre-determination, without being told to do so by an appellate court.

This man is a joke. I am going through a very difficult custody case and my child is very young. The few times I have been dragged to Ex Parte, he has not only mocked me and told me to “suck it up”, he also has openly said he did not read any of my submitted documents and declarations. We have proved MANY times that the opposing party is lying about just about everything in this case, and he does not read the documents I submit so he sees their lies and says “ok restraining orders granted”. So I have now TWICE had my child taken from me and given to the other party because of complete lies that have been proven wrong, and now my child is extremely confused and going through absolute trauma being tossed around houses like it’s in her best interest.

AVOID HIM WITH ALL COSTS. Clearly is biased towards mothers and does not give the time of day to even consider hearing what they have to say.

In a case where a commissioner (pro tem) and another judge (now retired) took a superficial look at, and a weak stand against, misguided (and perhaps predatory) litigators, Judge Shubert was thorough, principled, and wise. He courageously took a firm stand. I'd even say he was heroic. It help the involved family, as well as the attorneys, to be restored to some sense that our legal system can dispense justice and provide protection to the vulnerable. I only wish we had had someone like Judge Schubert from the start of the case and that all on the bench were of his stature, or close to it.

This is a very fair judge. He understands complex legal issues. His opinions are refreshing compared to half of the judges in Superior Court.
